S.I. No. 248/2004 - Road Traffic Act 2002 (Commencement of Certain Provisions) Order 2004


I, SÉAMUS BRENNAN, Minister for Transport, in exercise of the powers conferred on me by section 26 of the Road Traffic Act 2002 (No. 12 of 2002) and the National Roads and Road Traffic (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( S.I. No. 298 of 2002 ) (as adapted by the Public Enterprise (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 305 of 2002 )), hereby order as follows:

1. This Order may be cited as the Road Traffic Act 2002 (Commencement of Certain Provisions) Order 2004.

2. In this Order—

“Act of 1968” means the Road Traffic Act 1968 (No. 25 of 1968);

“Act of 1994” means the Road Traffic Act 1994 (No. 7 of 1994);

“Act of 2002” means the Road Traffic Act 2002 (No. 12 of 2002);

“Principal Act” means the Road Traffic Act 1961 (No. 24 of 1961).

3. The 4th day of June 2004 is fixed as the day on which the following provisions of the 2002 Act come into operation in respect of offences committed on or after that date:

(a) sections 8 and 22 in so far as they apply to offences under section 52 (as substituted by section 50 of the 1968 Act) of the Principal Act, and so much of Part 1 of the First Schedule as relates to the offence specified at reference number 9 of that part;

(b) section 25 (2) in so far as it applies to subsections (1) and (2) of section 36 (as amended by section 49(1)(d) of the 1994 Act) of the Principal Act in respect of the offence specified at reference number 9 in Part 1 of the First Schedule to the 2002 Act.
