S.I. No. 114/2004 - Censorship of Films (Fees) Order 2004


I, MICHAEL McDOWELL, Minister for Justice, Equality and Law Reform, in exercise of the powers conferred on me by sections 8 (2) and 11 of the Censorship of Films Act 1923 (No. 23 of 1923), as adapted by the Justice (Alteration of Name of Department and Title of Minister) Order 1997 ( S.I. No. 298 of 1997 ), and with the sanction of the Minister for Finance, order as follows:

1. This Order may be cited as the Censorship of Films (Fees) Order 2004.

2. This Order comes into operation on 1st April, 2004.

3. References to this Order to a section are references to a section of the Censorship of Films Act 1923 .

4. The fees to be charged under section 11(1) are those set out in the Schedule to this Order.

5. (1) The fee to be charged under section 11(2) in respect of an appeal to the Appeal Board is €1,000.

(2) In accordance with section 11(4), a fee so charged shall be refunded to the appellant concerned if the Appeal Board either reverses a decision of the Official Censor or varies it by relaxing or removing a restriction or condition attached to a limited certificate.

(3) The reference to the preceding paragraph to section 11(4) is to that provision as inserted by section 3 of the Censorship of Films (Amendment) Act 1992 (No. 29 of 1992).

6. The Censorship of Films (Fees) Order 1987 ( S.I. No. 341 of 1987 ) is revoked.

These Regulations prescribe the fees to be charged in relation to applications for the granting or refusal of certificates for films under Section 11 (1) and appeals under Section 11 (2) of the Censorship of Films Acts, 1923-1992.
