S.I. No. 35/2004 - Courts Service Act 1998 (Second Schedule) (Amendment) Order 2004


I, MICHAEL McDOWELL, Minister for Justice, Equality and Law Reform, in exercise of the powers conferred on me by section 29 (2) of the Courts Service Act, 1998 (No. 8 of 1998), hereby order as follows:

1. This Order may be cited as the Courts Service Act 1998 (Second Schedule) (Amendment) Order 2004.

2. The Second Schedule to the Courts Service Act 1998 is amended by the insertion in the appropriate chronological place of:

No. 48 of 1936

Courts of Justice Act 1936

In section 65, subsection (1) the words ‘and the persons by whom and the occasions on which such fees are to be paid and the officers by whom and the manner in which such fees are to be collected’.

This Order transfers responsibility for the collection of Court Fees to the Courts Service by way of amendment to the Second Schedule of the Courts Service Act 1998 with effect from the 23rd January 2004.
