S.I. No. 686/2003 - The European Communities (Establishment and Provision of Services in Architecture) (Amendment) Regulations 2003


The Minister for the Environment Heritage and Local Government, in exercise of the powers conferred on him by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving effect to Council Directive 2001/19/EU of 14 May 2001(*) amending Council Directive 85/384/EEC of 10 June 1985(**) on the mutual recognition of diplomas, certificates and other evidence of formal qualifications in architecture, including measures to facilitate the effective exercise of the right of establishment and freedom to provide services hereby makes the following Regulations -

Citation

1.        These Regulations shall be cited as the European Communities (Establishment and Provision of Services in Architecture)(Amendment) Regulations 2003.

Commencement

2.        These Regulations shall come into effect on 1 January 2004.

Interpretation

 3. (1)  In these Regulations-

“the Principal Regulations” means the European Communities (Establishment and Provision of Services in Architecture) Regulations 1989 ( S.I. No. 15 of 1989 ).

 (2)   The following definition is hereby substituted for the definition of “The Directive” in the Principal Regulations -

 “the Directive” means Council Directive 85/384/EEC of 10 June 1985 on the mutual recognition of diplomas certificates and other evidence of formal qualifications in architecture, including measures to facilitate the effective exercise of the right of establishment and freedom to provide services and published in the Official Journal (No. L 233) of the European Communities of 21 August, 1989, as amended by Council Directive 2001/19/EC of 14 May, 2001 and published in the Official Journal (No. L206) of 31 July 2001”.

Explanatory Note

Council Directive 2001/19/EC of 14 May, 2001, amended a number of Directives on the mutual recognition of professional qualifications, including the Architects Directive (85/384/EEC of 10 June, 1985).

These Regulations transpose technical amendments of the Architects Directive into national law.
