S.I. No. 343/2003 - Central Bank Act 1971 (Approval of Scheme of Rheinhyp Bank Europe Plc and Europaische Hypothekenbank S.A.) (No. 2) Order 2003

Whereas on 6 June 2003 the Minister for Finance made an order under section 33 of the Central Bank Act 1971 entitled the Central Bank Act 1971 (Approval of Scheme of Rheinhyp Bank Europe plc and Europaische Hypothekenbank S.A.) Order 2003 ( S.I. No. 239 of 2003 relating to this matter.

And Whereas the Scheme for the transfer dated 7 April 2003 refers to the Transferee as “Europaische Hypothekenbank S.A.”,

And Whereas the Transferee had changed its name with effect from 28 March 2003 to “Eurohypo Europaische Hypothekenbank S.A.;”

And Whereas it is now intended to amend the reference in that Order to the Transferee in order to identify it by reference to its present name.

NOW I, Charlie McCreevy, Minister for Finance, after consultation with the Central Bank and Financial Services Authority of Ireland and with the consent of the Transferor and the Transferee, in exercise of the powers conferred on me by section 33 (2) of the Central Bank Act 1971 , hereby order as follows:

1.      This Order may be cited as the Central Bank Act 1971 (Approval of Scheme of Rheinhyp Bank Europe plc and Europaische Hypothekenbank S.A.)(No. 2) Order 2003.

2.      Article 2 of the Central Bank Act 1971 (Approval of Scheme of Rheinhyp Bank Europe plc and Europaische Hypothekenbank S.A.) Order 2003 is amended by substituting the following for the definition of “Transferee”:

“ ‘Transferee’ means Eurohypo Europaische Hypothekenbank S.A.”

3.      This Order shall be deemed to come into operation on 6 June 2003.
