S.I. No. 649/2002 - Inland Post Amendment (No. 68) Scheme 2002


An Post, in exercise of the powers conferred on it by Section 70 of the Postal and Telecommunications Services Act 1983 (No. 24 of 1983) as amended by Regulation 8(4) of the European Communities (Postal Services) Regulations 2002, hereby makes the following Scheme:

1. This Scheme may be cited as the Inland Post Amendment (No. 68) Scheme 2002.

2. This Scheme shall be operative with effect from the 2nd day of April 2002.

3. In this Scheme "the Principal Warrant" means the Inland Post Warrant 1939 ( S.I. No. 202 of 1939 ) as amended;

"Scheme No. 60" means the Inland Post Amendment (No. 60) Scheme 1999 ( S.I. No. 61 of 1999 ).

4. Words defined in the Principal Warrant shall have the same meaning in this Scheme.

5. Regulation 5 of Scheme No. 60 is hereby amended by the substitution for that Regulation of the following:

"5. Senders seeking to make an arrangement with An Post shall provide to An Post or at An Post's option allow An Post to inspect in the senders' premises samples of the type of postal packets they intend sending showing the size, shape, weight, colour, location of address, return address, Ceadúnas stamp or postal franking impression and where relevant the proposed method of presentation of the postal packets and where relevant the machinery used to print, fold, envelope and address such postal packets."

6. Regulation 6 of Scheme No. 60 is hereby amended by the substitution for that Regulation of the following:

"6. There shall be charged and paid upon packets posted under this scheme the rates specified at (1) of the First Schedule to the Principal Warrant. Subject to adherence to the qualifying criteria as specified in the First or Second Schedule to this Scheme the sender shall benefit from the rebate per postal packet specified in that schedule. Notwithstanding the provision of Regulation 10 of the Principal Warrant all postal packets shall carry a prepaid Ceadúnas impression or postal franking impression approved by An Post."

7. Regulation 8 of the First Schedule of Scheme No. 60 is hereby amended by the substitution for that Regulation of the following:

"8. A rebate of 5 cent per item for qualifying postal packets shall apply."

8. Regulation 2 of the Second Schedule of Scheme No. 60 is hereby amended by the substitution for that Regulation of the following:

"2. An Post may test mailings in advance for their ability to meet the specifications notified to the sender. A minimum test quantity of 2,000 postal items shall be required. The minimum qualifying volume is 2,000 postal items per each unique posting event all originating from a single sender."

9. Regulation 3 of the Second Schedule of Scheme No. 60 is hereby amended by the substitution for that Regulation of the following:

"The normal posting days shall be Monday to Friday unless by special arrangement between the customer and An Post. Postal packets shall be available for collection before 11.00 a.m. or presented at the designated access point before 12 noon. Postings after 12 noon may be accepted as Early Presentation mail for the following working day. Each mailing must be accompanied by a detailed mailing docket."

10. Regulation 4 of the Second Schedule of Scheme No. 60 is hereby amended by the substitution for that Regulation of the following:

"4. Postal packets shall be of the same shape and size and fall within the same weight band. All postal packets must comply with the mailing guidelines set by An Post and must have a minimum Optical Character Recognition (OCR) read rate of 85%. Mailing guidelines will be supplied by An Post to the sender and may be varied from time to time. Postal packets within dimensions of 400mm (300mm (25mm and which do not require a cancellation mark or application of a postage paid indicator shall be qualifying postal packets for the purposes of this scheme."

11. Regulation 5 of the Second Schedule of Scheme No. 60 is hereby amended by the substitution for that Regulation of the following:

"5. Early Presentation rebates shall only apply to prepaid Ceadúnas mail or to mail with a postal franking impression."

12. Regulation 6 of the Second Schedule of Scheme No. 60 is hereby amended by the substitution for that Regulation of the following:

"6. All postal packets shall be sealed and the return address of the sender or other indicator of origin acceptable to An Post shall appear on the top left hand corner on the address side of each postal packet. Undelivered postal packets shall be delivered to he return address free of any additional postal charge."

13. Regulation 8 of the Second Schedule of Scheme No. 60 is hereby amended by the substitution for that Regulation of the following:

"8. A rebate of 3 cent per item for qualifying postal packets shall apply."

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Scheme applies to the Inland Post Service and shall be operative from the 2nd day of April 2002. It makes certain changes to the criteria for Early Presentation and Pre-Sortation of mail under which customers of An Post can avail of rebates.
