S.I. No. 500/2002 - Road Traffic (National Car Test) (Amendment) (No. 2) Regulations, 2002


The Minister for Transport, in exercise of the powers conferred on him by sections 5 and 18 of the Road Traffic Act 1961 (No. 24 of 1961), the National Roads and Road Traffic (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( S.I. No. 298 of 2002 ) (as adapted by the Public Enterprise (Alteration of Name of Department and Title of Minister) Order ( S.I. No. 305 of 2002 )) and for the purpose of giving effect to Commission Directive 2001/9/EC1 of 12 February 2001, hereby make the following regulations:

1.       (1)       These Regulations may be cited as the Road Traffic (National Car Test (Amendment) (No. 2) Regulations 2002.

(2)       The Principal Regulations, the Regulations of 2002 and these Regulations may be cited together as the Road Traffic (National Car Test) Regulations 2001 and 2002.

2.       In these Regulations -

“Principal Regulations” means the Road Traffic (National Car Test) (No. 3) Regulations 2001 ( S.I. No. 550 of 2001 );

“Regulations of 2002” means the Road Traffic (National Car Test) (Amendment) Regulations 2002 ( S.I. No. 55 of 2002 ).

3.       Article 2(1) of the Principal Regulations is amended by deleting the definition of “Minister”.

4.       Article 11 of the Principal Regulations is amended by inserting after sub-article (1A (inserted by Article 4 of the Regulations of 2002) the following:

“(1B) The measurement of the carbon monoxide (CO) content, at low engine idling speed in petrol driven vehicles equipped with on-board diagnostic systems in accordance with Directive 98/69/EC2 of the European Parliament and of the Council of 13 October 1998, may be determined through the appropriate reading of the on-board diagnostic device and simultaneous checking of the proper functioning of the on-board diagnostic systems.”.

These Regulations transpose Commission Directive 2001/9/EC regarding the use of on-board diagnostic systems to determine certain emissions in the conduct of roadworthiness testing of certain vehicles.
