S.I. No. 465/2002 - Statistics (Road Freight) Order 2002

I, Mary Hanafin Minister of State at the Department of the Taoiseach, in exercise of the powers conferred on me by section 25 (1) of the Statistics Act 1993 (No. 21 of 1993) and the Statistics (Delegation of Ministerial Functions) Order 2002 ( S.I. No. 313 of 2002 ) hereby order as follows:

1.           (1)         This Order may be cited as the Statistics (Road Freight) Order 2002.

(2)         This Order comes into operation on 30 September 2002.

2.           (1)         In this order -

“goods road transport vehicle” has the same meaning as it has in Article 2 of Council Regulation (EC) No. 1172/98 of 25 May 19981 ;

“registered” means entered in the register of vehicles established under section 131 of the Finance Act 1992 (No. 9 of 1992).

(2)          In this Order, unless the context otherwise requires, a reference to an Article or Schedule is a reference to an Article of or a Schedule to this Order.

3.           This Order applies to a person or undertaking that owns a goods road transport vehicle that is registered.

4.           A person or undertaking to whom this Order applies is prescribed as a person or undertaking required to provide the Central Statistics Office with information relating to goods road transport vehicles, the general nature of which information is specified in the Schedule.

5.           Information, the general nature of which is specified in the Schedule is prescribed as information required to be provided for the purposes of surveys of persons and undertakings to whom this Order applies.

6.           Information referred to in Article 5 shall be provided when requested by the Director General, weekly monthly, quarterly, half yearly or annually.

7.           (1)         Subject to paragraph (2) of this Article, a person or undertaking required by virtue of this Order to provide information to the Central Statistics Office shall provide such information by the completion of forms and questionnaires prepared by the Director General of the Central Statistics Office in accordance with section 23 of the Statistics Act, 1993 (No. 21 of 1993).

(2)         A person or undertaking required by virtue of this Order to furnish information shall be deemed to comply with that obligation where, with the consent of the Director General of the Central Statistics Office, the information is furnished by electronic means, and provided that the Director General approves the format or manner in which the information is provided.

Schedule

Particulars of -

1.        age of vehicle, change of ownership or whether vehicle has been scrapped,

2.        business of person or undertaking,

3.        work done by vehicle during the week to which the survey relates,

4.        carrying capacity of vehicle,

5.        weight and capacity of any trailer that the vehicle has,

6.        type of body that the vehicle has,

7.        type of work normally carried on by the vehicle,

8.        positions of axles on the vehicle.
