S.I. No. 424/2002 - European Communities (Characteristics and Minimum Conditions For Examining Vegetable Varieties) Regulations 2002


I, Joe Walsh, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) (as adapted by the Agriculture, Food and Rural Development (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 306 of 2002 )), and for the purpose of giving effect to Commission Directive 72/168/EEC of 14 April 19721 and Commission Directive 2002/8/EC of 6 February 20022 , hereby make the following Regulations:

1.   These Regulations may be cited as the European Communities (Characteristics and Minimum Conditions for Examining Vegetable Varieties) Regulations 2002.

2.   In these Regulations -

“Commission Directive” means Commission Directive 72/168/EEC of 14 April 1972 as amended by Article 1 of Commission Directive 2002/8/EC of 6 February 2002, and

“vegetable varieties” has the same meaning as in the Commission Directive.

3.   An official inspection carried out for the acceptance of vegetable varieties shall cover the characteristics listed in Annex 1 of Commission Directive.

4.   The conditions listed in Annex II of Commission Directive shall be fulfilled at time of inspection.
