S.I. No. 359/2002 - Freedom of Information Act 1997 (Prescribed Bodies) Regulations 2002


I, Charlie McCreevy, Minister for Finance, in exercise of the powers conferred on me by section 3 of the Freedom of Information Act 1997 (No. 13 of 1997) and to the extent that these Regulations relate to the respective functions of the Taoiseach, the Minister for Foreign Affairs, the Minister for Justice, Equality and Law Reform, the Minister for Arts, Sport and Tourism, the Minister for Transport, the Minister for Health and Children and the Minister for Community, Rural and Gaeltacht Affairs, with the consent of each of those Ministers, hereby make the following Regulations with respect to which, pursuant to section 3(3) of that Act, a draft has been laid before each House of the Oireachtas and a resolution approving of the draft has been passed by each such House:

1.         These Regulations may be cited as the Freedom of Information Act 1997 (Prescribed Bodies) Regulations 2002.

2.         These Regulations come into operation with effect from 1 June 2002.

3.         The bodies, organisations and groups specified in the Schedule to these Regulations stand prescribed for the purposes of paragraph 1(5) of the First Schedule to the Freedom of Information Act 1997 (No. 13 of 1997).

The Taoiseach consents to the making of these Regulations to the extent that they relate to the functions of the Taoiseach.

EXPLANATORY NOTE

(This not is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations prescribe each of National Economic and Social Council, National Economic and Social Forum, National Centre for Partnership and Performance, National Statistics Board, Information Society Commission, National Committee for Development Education, the Agency for Personal Service Overseas, Legal Aid Board, Victim Support National Disability Authority, National Consultative Committee on Racism and Interculturalism, The National Concert Hall, Chester Beatty Library, The Irish Museum of Modern Art, The Irish Film Board, Bord na Leabhar Gaeilge, Commission for Aviation Regulation and Campus and Stadium Ireland Development Limited as a public body for the purposes of the Freedom of Information Act, 1997 (No. 13 of 1997) by their inclusion in subparagraph (5) of paragraph 1 of the First Schedule to that Act.

These Regulations also ensure that records of the Mater Misericordiae Hospital Limited Children's University Hospital Limited and Our Lady's Hospice Limited can continue to be sought under the FOI Act following the incorporation of these bodies as limited companies.
