S.I. No. 186/2002 - Supplement To Postal Voters (Special Difficulty) Order, 2002


WHEREAS it appears to the Minister for the Environment and Local Government that for certain persons whose religious beliefs preclude secular activities on 17 May 2002 to an extent that debars the exercise by them of their franchise, there is a special difficulty, NOW THEREFORE the Minister for the Environment and Local Government in exercise of the powers conferred on him by section 164 of the Electoral Act, 1992 hereby orders as follows:-

1.   This order may be cited as the Supplement to Postal Voters (Special Difficulty) Order, 2002.

2.    Section 99 (2) of the Electoral Act, 1992 (inserted by section 25 of the Electoral (Amendment) Act, 2001 ) shall apply to a person who is a Dail elector subject to the following modifications:-

(a)    in paragraph (a)

(i) “is precluded by his religious beliefs from secular activities on 17    May, 2002 to an extent that debars the exercise of their franchise” is substituted for

“is employed by a returning officer for any purpose in connection with a Dail election and is registered to vote in a constituency other than the one in which the employment occurs,”

(ii) the substitution of “Minister.” for “Minister,” and the deletion of the text from “and the returning officer” to end of paragraph (a).

(b)                  in paragraph (c)

“to this order” is substituted for “to subsection (2)”.

2.   Section 15A (4) of the Electoral Act, 1992 (as amended) is hereby further amended by the deletion of all words from “after” (where it first occurs) to the end of the subsection and the substitution therefor of “11 May, 2002 shall not have effect in relation to the election of the 17 May, 2002.”.
