S.I. No. 71/2002 - Diseases of Animals Act 1966 (Foot-And-Mouth Disease) (Restriction on Imports From The United Kingdom) (No. 3) Order 2001 (Modification) Order 2002

I, Joe Walsh, Minister for Agriculture, Food and Rural Development, in exercise of the powers conferred on me by sections 3 and 30 of the Diseases of Animals Act 1966 (No. 6 of 1966) (as adapted by the Agriculture and Food (Alteration of Name of Department and Title of Minister) Order 1999 ( S.I. No. 307 of 1999 )), and for the purpose of giving effect to the Commission Decision 2001/740/EC of 19 October 2001¹ as amended by Commission Decision 2001/763/EC of 30 October 2001² , Commission Decision 2001/789/EC of 12 November 2001³ , Commission Decision 2001/848/EC of 30 November 2001⁴ , Commission Decision 2001/911/EC of 19 December 2001⁵ and Commission Decision 2001/938/EC of 28 December 2001⁶ , Commission Decision 2002/37/EC of 15 January 2001⁷ and Commission Decision 2002/48/EC of 23 January 2002⁸ , as well as Commission Decision 2002/153/EC of 20 February 2002⁹ , hereby order as follows:-

1.       This Order may be cited as the Diseases of Animals Act 1966 (Foot-and-Mouth Disease) (Restriction on Imports from the United Kingdom (No. 3) Order 2001 (Modification) Order 2002.

2.(1)   In this Order “Commission Decision” means Commission Decision No. 2002/153/EC of 20 February 2002⁸ .

 (2)  A word or expression that is used in this Order and that is also used in the Commission Decision, has, unless the contrary intention appears, the same meaning in this Order as it has in the Commission Decision.

 (3)  In this Order, unless the contrary intention appears, a reference to an Article is to an Article of this Order and a reference to a Schedule is to the Schedule of this Order.

3.       Subject to Article 4, the Orders mentioned in the Schedule are revoked.

4.       The Orders that, but for the making of this Article, are revoked by Article 3 shall continue to apply to the import of -

(a)       meat to which Article 1 of the Commission Decision refers, or

(b)       a meat product to which Article 2 of the Commission Decision refers

and to the possession, control, sale or supply of such meat or meat product.

3.       Diseases of Animals Act 1966 (Foot-and-Mouth Disease) (Restriction on Imports from the United Kingdom) (No. 3) Order 2001 (Amendment Order 2002 ( S.I. No. 6 of 2002 ).

4.       Diseases of Animals Act 1966 (Foot-and-Mouth Disease) (Restriction on Imports from the United Kingdom) (No. 3) Order 2001 (Second Amendment) Order 2002 ( S.I. No. 12 of 2002 ).

EXPLANATORY NOTE

(this note is not part of the instrument and does not purport to be a legal interpretation)

This Order takes the necessary steps to remove restrictions on certain imports (other than imports of certain meat and meat products) from the United Kingdom in accordance with Commission 2002/153/EC.
