S.I. No. 573/2001 - Local Government (Water Pollution) (Fees) Regulations, 2001


In exercise of the powers conferred on the Minister for the Environment and Local Government by sections 9 and 30 of the Local Government (Water Pollution) Act, 1977 (No. 1 of 1977), by sections 6, 7, 17 and 19 of that Act as amended respectively by sections 4 , 5 , 13 and 14 of the Local Government (Water Pollution) (Amendment) Act, 1990 (No. 21 of 1990), and by section 21 of the Local Government (Water Pollution) Act, 1977 as substituted by section 16 of the Local Government (Water Pollution) (Amendment) Act, 1990 , which said powers are delegated to me by the Environment and Local Government (Delegation of Ministerial Functions) (No.2) Order, 1997 ( S.I. No. 428 of 1997 ), I, Dan Wallace, Minister of State at the Department of the Environment and Local Government, hereby make the following Regulations:

1.       (1)       These Regulations may be cited as Local Government (Water Pollution)(Fees) Regulations, 2001.

(2)       These Regulations, the Local Government (Water Pollution) Regulations, 1978 ( S.I. No. 108 of 1978 ), the Local Government (Water Pollution)(Nutrient Management Planning and Consultation) Regulations, 1998 ( S.I. No. 257 of 1998 ), and the Local Government (Water Pollution) Regulations, 1992 ( S.I. No. 271 of 1992 ) as amended by the Local Government (Water Pollution) (Amendment) Regulations, 1996 ( S.I. No. 184 of 1996 ) and the Local Government (Water Pollution)(Amendment) Regulations, 1999 ( S.I. No. 42 of 1999 ), shall be construed together as one and may be collectively cited as the Local Government (Water Pollution) Regulations, 1978 to 2001.

2.       These Regulations shall come into operation on 1 January 2002.

3.       The Local Government (Water Pollution) Regulations, 1992 ( S.I. No. 271 of 1992 ) are hereby amended by the substitution of —

(a)    “€380” for “£300” in articles 7(2) and 8(2)

(b)    “€126” for “£100” in article 14(2)

(c)    “€63” for “£50” in articles 14(3) and 16(3)

(d)    “€38” for “£30” in article 18(4), and

(e)    “€6” for “£5” in article 38.

These Regulations provide for conversion to convenient euro (€) amounts of fees payable under the Local Government (Water Pollution) Acts. The new fees will take effect on 1 January 2002 and have in all cases been rounded down on conversion in favour of the consumer.
