S.I. No. 314/2001 - Diseases of Animals Act, 1966 (Control on Movement of Sheep) Order, 2001


I, Joe Walsh, Minister for Agriculture, Food and Rural Development, in exercise of the powers conferred on me by sections 3 , 5 , 27 (a) and 28 (a) of the Diseases of Animals Act, 1966 (No. 6 of 1966) (as adapted by the Agriculture and Food (Alteration of Name of Department and Title of Minister) Order, 1999 ( S.I. No. 307 of 1999 )), hereby order as follows:-

1.       This Order may be cited as the Diseases of Animals Act, 1966 (Control on Movement of Sheep) Order, 2001 and shall come into operation on 2nd July, 2001.

2.       In this Order —

“animal identification number” and “individual animal identification number” have the same meaning as in the Diseases of Animals Act, 1966 (National Sheep Identification System) Order, 2001 ( S.I. No. 281 of 2001 );

“ear-tag” means an ear-tag approved pursuant to the Diseases of Animals Act, 1966 (National Sheep Identification System) Order, 2001 ( S.I. No. 281 of 2001 ) that bears —

(a)     the animal identification number issued or deemed to be issued to the owner of a sheep, and

(b)     the individual animal identification number of the sheep;

“sheep” means an animal of the ovine species and includes lambs.

3.(1)   A person shall not move a sheep or cause a sheep to be moved —

(a)     onto a commonage from another place whether such commonage is part of a holding or otherwise, or

(b)     from a commonage to another place

unless the sheep has an ear-tag inserted in its ear.

(2)    A person shall not move a sheep or cause a sheep to be moved in accordance with paragraph (1) of this Article unless he or she has given at least 24 hours advance notice in writing specifying —

(a)     the place from which the sheep is to be moved,

(b)     the place to which the sheep is to be moved, and

(c)     the identity, by reference to the animal identification number and individual animal identification number, of each sheep.

to the District Veterinary Office for the area from which the sheep is to be moved and, if applicable, the District Veterinary Office for the area to which the sheep is to be moved.

4.       A person shall not have a sheep that has been moved in contravention of Article 3 in his or her possession or under his or her control.

5. (1)  A person shall not have a sheep in his or her possession or under his or her control on a commonage unless that person has the right to graze sheep on the commonage.

(2)   A person who moves a sheep onto or from a commonage shall record the movement in his or her flock register.

6.       Nothing in this Order shall affect the operation of —

(a)      the Diseases of Animals Act, 1966 (Restriction on Movement of Certain Animals) (No. 2) Order, 2001 ( S.I. No. 308 of 2001 ) as amended by the Diseases of Animals Act, 1966 (Restriction on Movement of Certain Animals) (No. 2) (Amendment) Order, 2001 ( S.I. No. 315 of 2001 ), or

(b)      the Diseases of Animals Act, 1966 (National Sheep Identification System) Order, 2001 ( S.I. No. 281 of 2001 ).
