S.I. No. 63/2001 - The Foot and Mouth (Restriction on Movement) (No. 4) Order 2001


I, Joe Walsh, Minister for Agriculture, Food and Rural Development, in exercise of the powers conferred on me by sections 3 and 13 of the Diseases of Animals Act, 1966 (No. 6 of 1966), and Article 41 of the Foot and Mouth Disease Order, 1956 ( S.I. No.324 of 1956 ), hereby order as follows:

1.       This Order may be cited as the Foot and Mouth (Restriction on Movement) (No.4) Order, 2001

2        (1)     In this Order —

“animal” includes poultry and the carcases of animals;

“licence” means a licence granted under Article 8;

“area” means that part of the County Louth other than the District Electoral Division of Ravensdale, north of the national road known as the N53 and that part of of the county of Louth that lies east of a line drawn northwards along the road known as the N1 from its junction with the said N53 at Dundalk District Electoral Division of Ravensdale in the county of Louth;

“produce” includes animal waste, slurry, eggs, fodder, meat and other food of animal origin, raw milk and milk products, semen, ova and embryos;

“sell” includes offer, expose or keep for sale, invite an offer to buy, or distribute for reward and cognate words shall be construed accordingly;

“specified officer” means an officer of the Minister not below the grade of executive officer, an authorised person or an inspector;

“supply” includes giving without payment.

(2)      A reference in this Order to an Article is a reference to an Article of this Order, unless it is indicated that a reference to some other Order is intended.

3.       The area is declared to be a controlled area under the Foot and Mouth Disease Order, 1956 ( S.I. No. 324 of 1956 ).

4.       A person shall not move an animal or produce into the area save under and in accordance with a licence.

5.       A person shall not move an animal or produce from the area save under and in accordance with a licence.

6.       (1) A person shall not move an animal or produce from one place within the area to another place within the area save under and in accordance with a licence.

(2) Paragraph (1) shall not apply to the movement of an animal from one part of a holding to another where such movement does not involve passage through a public place.

7.       A person shall not have in his possession or under his control, sell or supply an animal or produce that has been moved in contravention of Article 4,5, or 6.

8.       (1) A specified officer may, on application being made in writing in that behalf by the owner of an animal or produce, grant a licence authorising the -

(a) movement of an animal or produce within the area,

(b) movement of an animal or produce from a place within the area to a place outside the area;

(c) movement of an animal or produce from a place outside the area (other than a place in the United Kingdom of Great Britain and Northern Ireland) to a place inside the area; or

(d) transit of animals or produce directly through the area by rail.

(2)       An application for a licence under this Article shall contain such information as a specified officer may request.

(3)       A licence under this Article shall be subject to such conditions as a specified officer may require.

(4)       A specified officer shall not issue a licence under this Article if he has reasonable grounds to consider that there may be a risk to animal health.

(5)       A person shall not move an animal or produce in respect of which a licence has been granted unless the licence accompanies the animal or produce.

9.       A specified officer -

(a) where he has reasonable grounds to consider that considers that there may be a risk to animal health;

(b) where he cannot readily ascertain the owner of an animal; or

(c) where an animal is being moved other than under and accordance with a licence,

may slaughter the animal or cause it to be slaughtered and may seize and detain any vehicle in, on or under which the animal is or was being transported.

10.     A specified officer-

(a)              where he has reasonable grounds to consider that there is a risk considers that there may be a risk to animal health,

(b)              where he cannot readily ascertain the owner of any produce, or

(c)              where produce is being moved other than under and accordance with a licence,

may seize and detain such produce and any vehicle in, on or under which it is being transported and may dispose of such produce in such manner as he considers appropriate.

11. Articles 36 and 39 of the Foot and Mouth Disease Order, 1956 ( S.I. No. 324 of 1956 ) shall apply in the area.

12. A person shall not hold or permit to be held any sports meeting or fair, market or other sale, exhibition or any gathering of animals in the area.

13. A person shall not engage in artificial insemination under the Live Stock (Artificial Insemination) Act, 1947 (No. 32 of 1947) and the LiveStock (Artificial Insemination) Regulations, 1948 ( S.I. No. 55 of 1948 ) in the area save under and in accordance with a permit issued by an inspector or an authorise person.
