S.I. No. 404/2000 - Copyright and Related Rights Act, 2000 (Commencement) Order, 2000


I, TOM KITT, Minister of State at the Department of Enterprise, Trade and Employment, d in exercise of the powers conferred on me by section 1 (2) of the Copyright and Related Rights Act, 2000 (No. 28 of 2000), and the Enterprise, Trade and Employment (Delegation of Ministerial Functions) (No. 2) Order, 1997 ( S.I. No. 330 of 1997 ), hereby order as follows:

1.        This Order may be cited as the Copyright and Related Rights Act, 2000 (Commencement) Order, 2000.

2.        The 1st day of January, 2001, is hereby appointed as the day on which provisions of the Copyright and Related Rights Act, 2000 (No. 28 of 2000), specified in the Schedule to this Order, shall come into operation.

SCHEDULE

(Regulation 2)

1.       Part I, all sections except section 10(2) in so far as it applies to section 56 of the Copyright Act, 1963 (No. 10 of 1963);

2.       Part II, all sections except-

(a)  section 98;

(b)  section 198; and

(c)  section 199;

3.       Part III, all sections except section 247;

4.       Part IV;

5.       Part V;

6.       Part VI; and

7.       Part VII.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation).

This Order appoints the 1st of January 2001 as the date on which specified sections of the Copyright and Related Rights Act, 2000 (No. 28 of 2000) come into operation. The specified sections are as follows: In Part I, all sections except section 10(2) insofar as it relates to section 56 of the Copyright Act, 1963 ; in Part II, all sections except section 98 “Playing of sound recordings for clubs, societies, etc.”, section 198 “Delivery of certain materials to libraries”, and section 199 “Amendment of sections 65 and 66 of the National Cultural Institutions Act, 1997 ”; in Part III, all sections except section 247 “Playing of sound recordings for clubs, societies, etc.”; in Part IV, all sections; in Part V, all sections; in Part VI, all sections; and in Part VII, all sections.
