S.I. No. 282/2000 - Aquaculture (Licence Fees) Regulations, 2000.


I, FRANK FAHY, Minister for the Marine and Natural Resources, in exercise of the powers conferred on me by section 64 of the Fisheries (Amendment) Act, 1997 (No. 23 of 1997) (as adapted by the Marine (Alteration of Name of Department and Title of Minister) Order, 1997 ( S.I. No. 301 of 1997 )), and with the consent of the Minister for Finance, hereby make the following Regulations:

1. (1) These Regulations may be cited as the Aquaculture (Licence Fees) Regulations, 2000.

(2) These Regulations shall come into operation on 1 October, 2000.

2. Regulation 5 of the Aquaculture (Licence Application and Licence Fees) Regulations, 1998 ( S.I. No. 270 of 1998 ), and Regulation 5 of the Aquaculture (Licence Application and Licence Fees) (No. 2) Regulations, 1998 ( S.I. No. 324 of 1998 ), are hereby amended by the insertion of the following proviso:

“Provided that where the fee payable exceeds £1,000, the licensee may pay to the Minister—

(a) one-half of the fee on the granting of the licence and one-half of the fee not later than 6 months after the granting of the licence, and

(b) while the licence is in force, one-half of the fee on each anniversary of the granting of the licence and one-half of the fee not later than 6 months after each anniversary.”.

The Minister for Finance consents to the making of the foregoing Regulations.

EXPLANATORY NOTE.

These Regulations permit holders of aquaculture licences to pay their fees in two equal instalments (at six-monthly intervals), where the fee exceeds £1,000 on the granting or on the anniversary of the granting of the licences.
