S.I. No. 151/2000 - Infectious Diseases (Amendment) Regulations, 2000.


The Minister for Health and Children, in exercise of the powers conferred on him by section 5 and 29 of the Health Act, 1947 (No. 28 of 1947) and by section 31 of the said Act, as amended by section 34 of the Health Act, 1953 (No. 26 of 1953), hereby makes the following regulations:

Citation.

1. These Regulations may be cited as the Infectious Diseases (Amendment) Regulations, 2000.

Interpretation.

2. In these Regulations the expression “Principal Regulations” means the Infectious Diseases Regulations, 1981 ( S.I. No. 390 of 1981 ).

Effective date.

3. These Regulations shall come into operation on the 1st day of July, 2000.

Amendments.

4. (1) Article 2 is hereby amended by the insertion therein after ““the Minister” means the Minister for Health” the following:

“The expression “National Disease Surveillance Centre” means the centre of this name with an address at Sir Patrick Dun's Hospital, Lower Grand Canal Street, Dublin 2.”

“The expression “Director of the National Disease Surveillance Centre” means the person appointed as Director of the said Centre.”

(2) Article 18 is hereby amended by the substitution of the following in place of the existing text:

(1) “A medical officer of health shall furnish to the Director of the National Disease Surveillance Centre by the Wednesday of each week a return of the cases of infectious diseases notified to him/her in the week ending on the previous Saturday.”

(2) “A medical officer of health shall furnish to the Minister, or to the Director of the National Disease Surveillance Centre, as soon as possible a detailed report on each case of such infectious disease as the Minister or the Director of the National Disease Surveillance Centre respectively may specify from time to time.”

(2) Article 20(1) is hereby amended by the substitution of the following in place of the existing text:

(1) “A health board shall keep such records as may be directed by the Minister or as required by the Director of the National Disease Surveillance Centre from time to time in relation to the exercise of its powers and the performance of its duties under these Regulations.”

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations provide for the amendment of the Infectious Diseases Regulations, 1981 ( S.I. No. 390 of 1981 ) to enable the health boards to furnish to the Director of the National Disease Surveillance Centre, rather than to the Minister for Health and Children, weekly returns of the cases of infectious diseases notified to them. They also provide for the provision by health boards to the Minister, or to the Director of the National Disease Surveillance Centre, of a detailed report on each case of such infectious disease as may be specified from time to time.
