S.I. No. 368/1999 - Merchant Shipping (Life-Saving Appliances) (Amendment) Rules, 1999.


I, MICHAEL WOODS, Minister for the Marine and Natural Resources, in exercise of the powers conferred on me by section 427 of the Merchant Shipping Act, 1894 (as amended by section 11 of the Merchant Shipping (Safety Convention) Act, 1952 (No. 29 of 1952) and section 10 of the Merchant Shipping Act, 1966 (No. 20 of 1966)) and the Communications (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 ( S.I. No. 91 of 1987 ) as adapted by the Marine (Alteration of Name of Department and Title of Minister) Order, 1997 ( S.I. No. 301 of 1997 ), hereby make the following Rules:

1. These rules may be cited as the Merchant Shipping (Life-Saving Appliances) (Amendment) Rules, 1999 and shall come into operation on the 1st April, 2000.

2. The Merchant Shipping (Life-Saving Appliances) Rules, 1967 ( S.I. No. 100 of 1967 ) are amended by the substitution for Rule 17(10) of the following:

“(10) Every ship to which this Rule applies of less than 40 feet in length shall carry—

(a) no less than two lifebuoys, and

(b) for every person on board—

(i) weighing 70 pounds or more, a lifejacket that complies with the requirements of Part I of the Twelfth Schedule to these Rules, and

(ii) weighing less than 70 pounds, a lifejacket that complies with the requirements of Part II of the said Schedule.”.

These Rules amend section 17 (10) of the Merchant Shipping (Life-Saving) Appliances Rules 1967 ( S.I. No. 100 of 1967 ) in relation to the requirement to carry lifejackets on fishing vessels of less than 40 feet in length.
