S.I. No. 222/1999 - Local Authorities (Officers and Employees) Act, 1926 Local Authorities (Declaration of Offices) Order, 1999


The Minister for the Environment and Local Government in exercise of the powers conferred on him by subsection (1) of section 2 of the Local Authorities (Officers and Employees) Act, 1926 , as amended by section 11 of the Local Government Act, 1998 , with the concurrence of the Local Appointments Commissioners, hereby orders as follows:—

1 (1) This order may be cited as the Local Authorities (Declaration of Offices) Order, 1999.

(2) In this order, “the Act” means the Local Authorities (Officers and Employees) Act, 1926 .

2. Each and every declaration made under section 2 of the Act applying the said Act to any office under a local authority in relation to which the Minister for the Environment and Local Government is the appropriate Minister for the purpose of Part II of the Local Government Act, 1941 , Part III of the Local Government Act, 1946 and Chapter I of Part II of the Local Government Act, 1955 , is hereby revoked.

3 (1) The local authority offices described in the Schedule to this order are hereby declared to be offices to which the Act applies.

(2) Where, on or before the date hereof, the Local Appointments Commissioners have advertised a competition for an office which but for the making of the Local Government Act, 1998 (Commencement) Order, 1999, would be an office to which the Act applied, that office shall continue to be an office to which the Act applies for the purposes of that competition.

Assistant City Manager (Cork)

Assistant Director, An Chomhairle Leabharlanna

Assistant Town Clerk (Cork, Galway, Limerick and Waterford Corporations)

County Secretary

County/City Librarian

Deputy City Librarian

Deputy Finance Officer and Treasurer

Director, An Chomhairle Leabharlanna

Director of Community and Enterprise

Dublin City Librarian

Finance Officer

Finance Officer and Treasurer, Dublin Corporation

Financial Controller, Cork County Council

Librarian, An Chomhairle Leabharlanna

Personnel Officer, Dublin Corporation

Town Clerk of an Urban District Council with a population in excess of 15,000

and

every office under a local authority in respect of which the Minister for the Environment and Local Government is the appropriate Minister the qualifications for which are wholly or in part professional and the maximum salary for which is not less than the maximum salary for the time being for the office of Senior Executive Engineer.

This order specifies the offices to which the Local Authorities (Officers and Employees) Act, 1926 , as amended by section 11 of the Local Government Act, 1998 , will apply and provides for the continued application of the 1926 Act to offices, the competitions for which were advertised by the Local Appointments Commissioners on or before the date this order was signed. All previous declarations for offices under the 1926 Act in respect of which the Minister for the Environment and Local Government is the appropriate Minister are revoked.
