S.I. No. 209/1999 - Freedom of Information Act, 1997 (First Schedule) (Amendment) Regulations, 1999.


I, CHARLIE McCREEVY, Minister for Finance, in exercise of the powers conferred on me by section 3 of the Freedom of Information Act, 1997 (No. 13 of 1997), hereby make the following regulations with respect to which, pursuant to section 3(3) of that Act, a draft has been laid before each House of the Oireachtas and a resolution approving of the draft has been passed by each such House:

1. These Regulations may be cited as the Freedom of Information Act, 1997 (First Schedule) (Amendment) Regulations, 1999.

2. In subparagraph (2) of paragraph 1 of the First Schedule to the Freedom of Information Act, 1997 (No. 13 of 1997), “the Irish Sports Council” shall be construed as meaning either or both—

(a) the Irish Sports Council as appointed by the Minister of State at the Department of Education with special responsibility for Youth Affairs and Sport on 9 July 1996, and

(b) the Irish Sports Council as established by the Irish Sports Council Act, 1999 (No. 6 of 1999).

EXPLANATORY NOTE.

The Irish Sports Council, as established by the Irish Sports Council Act, 1999 , came into being on 1 July 1999. These regulations provide that any reference to the Irish Sports Council in the First Schedule of the FOI Act shall be construed as meaning either or both the Irish Sports Council provided for in the Irish Sports Council Act of 1999 or the Irish Sports Council appointed on 9 July 1996 by the Minister of State at the Department of Education with special responsibility for Youth Affairs and Sport. The regulations have the effect of ensuring that records of either or both forms of the Irish Sports Council can be sought under the Freedom of Information Act, 1997 .
