S.I. No. 190/1999 - Local Government (Major Offices) Order, 1999.


The Minister for the Environment and Local Government in exercise of the powers conferred on him by Part II of the Local Government Act, 1941 (No. 23 of 1941) hereby declares and orders as follows:—

1. This Order may be cited as the Local Government (Major Offices) Order, 1999.

2. In this Order, the following words and expressions shall have the meanings hereby assigned to them—

“the Act” means the Local Government Act, 1941 (No. 23 of 1941);

“office” means any office within the meaning of Part II of the Act in relation to which the Minister for the Environment and Local Government is the appropriate Minister.

3. The Local Government (Offices) Order, 1952 ( S.I. No. 170 of 1952 ) and every declaration or order made under Section 9 of the Act declaring an office to be a major office are hereby revoked.

4. (1) Subject to sub-article (2) hereof, every office in respect of which the maximum remuneration exceeds the maximum remuneration for the Office of Clerical Officer shall be a major office.

(2) Sub-article (1) shall not apply to an office for so long but only for so long as the holder thereof on the date hereof is a member of a local authority consequent upon the local elections held on the 11th day of June, 1999.

EXPLANATORY NOTE.

This order declares that every local authority ofice in respect of which the maximum remuneration exceeds the maximum remuneration for the office of Clerical Officer shall be a major office. All existing Major Offices orders are revoked whilst exemptions are provided for certain serving officers.
