EUROPEAN COMMUNITIES (INTERNAL MARKET IN ELECTRICITY) REGULATIONS, 1998.

I, MARY O'ROURKE, Minister for Public Enterprise, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Directive No. 96/92/EC of the European Parliament and of the Council of 19th December 1996 concerning common rules for the internal market in electricity 1, hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Internal Market in Electricity) Regulations, 1998.

2. Section 37 of the Electricity (Supply) Act, 1927 (No. 27 of 1927), is hereby amended by the addition of the following subsection after subsection (8):

"(9) Any permit granted under this section after the making of the European Communities (Internal Market in Electricity) Regulations, 1998, shall be deemed to contain a condition that it shall be subject to modification for the purpose of compliance with any enactment implementing, whether in whole or in part, Council Directive No. 96/92/EC of the European Parliament and of the Council of 19 December 1996 concerning common rules for the internal market in electricity, and, without prejudice to the generality of the foregoing, such modification may include modification of the duration of the permit and for the imposition of licence fees.".

EXPLANATORY NOTE.

The purpose of the Regulations is to give legal effect to Directive No. 96/92/EC of the European Parliament and of the Council of 19th December, 1996 concerning common rules for the internal market in electricity by providing that permits granted under section 37 of the Electricity (Supply) Act, 1927 shall be subject to modification for the purpose of compliance with any enactment implementng, whether in whole or in part, the Directive.
