OIREACHTAS (ALLOWANCES TO MEMBERS) (TRAVELLING FACILITIES) (AMENDMENT) REGULATIONS, 1998.

I, CHARLIE McCREEVY, Minister for Finance, in exercise of the powers conferred on me by section 5 (as amended by section 18 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary, Judicial and Court Offices (Amendment) Act, 1998 (No. 5 of 1998)) of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1964 (No. 14 of 1964), and the Public Service (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 ( S.I. No. 81 of 1987 ), hereby make the following regulations:

1. (1) These Regulations may be cited as the Oireachtas (Allowances to Members) (Travelling Facilities) (Amendment) Regulations, 1998.

(2) These Regulations shall be deemed to have come into operation on the 7th day of April, 1998, and shall be deemed to have ceased to have effect on the 1st day of May, 1998.

2. The Oireachtas (Allowance to Members) (Travelling Facilities) (Amendment) Regulations, 1994 ( S.I. No. 343 of 1994 ), are hereby amended in Regulation 3—

(a) by the substitution for paragraph (c) (i) of the following paragraph—

"(c) a mileage allowance at the rates payable to civil servants for cars coming within the highest engine capacity category:", and

(b) by the deletion of paragraph (c) (ii).

3. The form in which a member of Dáil Éireann or Seanad Éireann may make a claim for payment of an allowance under—

(a) the Oireachtas (Allowances to Members) (Travelling Facilities) (Amendment) Regulations, 1994 ( S.I. No. 343 of 1994 ), or

(b) section 1 (inserted by section 2 of the Oireachtas (Miscellaneous Provisions) and Ministerial and Parliamentary Offices (Amendment) Act, 1996 (No. 39 of 1996), as amended by section 15 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary, Judicial and Court Offices (Amendment) Act, 1998 (No. 5 of 1998)) of the Oireachtas (Allowances to Members) Act, 1962 (No. 32 of 1962),

may be in the form set out in the Schedule to these Regulations.

Section A

(Applies only to a member of either House of the Oireachtas whose normal place of residence for the time being is within 10 miles of Leinster House, or to a member whose normal place of residence for the time being is between 3(a) of S.I. No. 343 of 1994 ).

Claim A — This claim is for travelling facilities in respect of travelling expenses which I incurred in respect of my attendance, during the period of this claim, at Leinster House. I hereby claim the flat-rate daily travel allowance in respect of ....... days during the claim period.

Section B

(Applies to a member of either House of the Oireachtas whose normal place of residence for the time being is more than 20 miles from Leinster House or which is between 10 and 20 miles from Leinster House and who opts to claim under Regulation 3(c) of S.I. No. 343 of 1994 .)

Claim B — This claim is for travelling facilities in respect of travelling expenses which I incurred in respect of my attendance, during the period of this claim, at Leinster House. I hereby claim mileage allowance in respect of .... one-way journeys between my normal place of residence for the time being and Leinster House each being of ..... miles.

Section C

(Applies to a member of either House of the Oireachtas whose normal place of residence for the time being is more than 20 miles from the GPO in Dublin.)

Claim C.1 — This claim is for overnight allowances in respect of overnight stays which I made in the Dublin area in respect of my attendance, during the period of this claim, at meetings of Dáil Éireann or Seanad Éireann or of Committees thereof, of which I was a member or a duly nominated substitute. I hereby claim the overnight allowance in respect of ....... overnight stays in the Dublin area. Where Committees met during recess, state committee name(s) and dates:

Claim C.2 — This claim is for overnight allowances in respect of overnight stays (on occasions for which I was not entitled to an allowance under C.1 above) which I made in the Dublin area in respect of my attendance, during the period of this claim, at meetings held in Leinster House between members of either or both Houses of the Oireachtas to discuss parliamentary business. I hereby claim the overnight allowances in respect of ....... overnight stays in the Dublin area. (Note: maximum of 5 overnight allowances per annum payable under this provision.)

Claim C.3 — This claim is for overnight allowances in respect of overnight stays (on occasions for which I was not entitled to an allowance under C.1 or C.2 above) which I made in the Dublin area in respect of my attendance, during the period of this claim, at Leinster House for the purpose of using its facilities. I claim the overnight allowances in respect of ..... overnight stays in the Dublin area. (Note: maximum of 25 overnight allowances per annum payable under this provision.)

EXPLANATORY NOTE.

These Regulations amend S.I. No. 343 of 1994 concerning travelling facilities for Oireachtas members and also prescribe the manner in which claims for payment of travelling facilities and of overnight allowances may be claimed by Members of the Oireachtas in the period 7 April, 1998 to 30 April, 1998.
