SHANNON NAVIGATION (EXTENSION OF LIMITS OF NAVIGATION) BYE-LAWS, 1998.

WHEREAS the southern limits of the river Shannon for the purposes of the Act of the British Parliament 2 & 3 Vict., c. 61, as amended, and the Shannon Navigation Act, 1990 (No. 20 of 1990), stand fixed and determined under the first-mentioned Act as Baal's Bridge and Thomond Bridge both in the county and city of Limerick;

AND WHEREAS the Minister for Arts, Heritage, Gaeltacht and the Islands proposes by these Bye-laws to fix and determine the southern limits of the said river Shannon in the county and city of Limerick so as to extend those limits fixed and determined as aforesaid to include, firstly, the part of the said river Shannon between Thomond Bridge aforesaid (which connects the parish of St. Nicholas with the parishes of St. Munchin and St. Mary) in the city of Limerick and the upstream face of Mallow Street Bridge (which connects the parish of St. Nicholas with the parish of St. Michael) in the city of Limerick and, secondly, the part of the branch of the said river Shannon known as the river Abbey between Baal's Bridge aforesaid (which connects the parish of St. Mary with the parish of St. John) in the city of Limerick and the confluence of that branch with the said river Shannon, in the city of Limerick.

NOW I, Síle De Valera, Minister for Arts, Heritage, Gaeltacht and the Islands, in exercise of the powers conferred on me by section 39 of the Act of the British Parliament 2 & 3 Vict., c. 61 and section 3 of the Shannon Navigation Act, 1990 (No. 20 of 1990), hereby make the following Bye-laws:

1. These Bye-laws may be cited as the Shannon Navigation (Extension of Limits of Navigation) Bye-laws, 1998.

2. These Bye-laws shall come into operation on the 27th day of June, 1998.

3. The southern limits of the river Shannon (including the branch thereof known as the river Abbey in the city of Limerick) are hereby fixed and determined for the purposes of the Shannon Act and the Shannon Navigation Act, 1990 (No. 20 of 1990), as the upstream face of Mallow Street Bridge (which connects the parish of St. Nicholas with the parish of St. Michael) in the city of Limerick.

EXPLANATORY NOTE

Section 39 of the Act of the British Parliament 2 & 3 Vict., c. 61 and Section 3 of the Shannon Navigation Act, 1990 (No. 20 of 1990) empowers the Minister for Arts, Heritage, Gaeltacht and the Islands to make Bye-laws extending the limits of the Navigation. This Bye-law extends the Southern limits of Navigation of the River Shannon (including the branch thereof known as the River Abbey in the City of Limerick), to the upstream face of Mallow Street Bridge in the City of Limerick, and so brings this section of the River within the scope of Shannon Legislation.
