MEMBERS OF THE OIREACHTAS AND MINISTERIAL AND PARLIAMENTARY OFFICES (ALLOWANCES AND SALARIES) ORDER, 1998.

The Government, in exercise of the powers conferred on them by—

(a) section 3A (inserted by section 5 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973)) of the Oireachtas (Allowances to Members) Act, 1938 (No. 34 of 1938), and

(b) section 8A (inserted by section 11 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 ) of the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938),

hereby order as follows:

1. This Order may be cited as the Members of the Oireachtas and Ministerial and Parliamentary Offices (Allowances and Salaries) Order, 1998.

2. In this Order—

"Act of 1938" means the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938);

"Act of 1973" means the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973);

"Act of 1977" means the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 (No. 29 of 1977);

"Act of 1996" means the Oireachtas (Miscellaneous Provisions) and Ministerial and Parliamentary Offices (Amendment) Act, 1996 (No. 39 of 1996).

3. (1) The annual sum by way of salary payable monthly under subsection (1) (inserted by the Act of 1973) of section 3 of the Oireachtas (Allowances to Members) Act, 1938 (No. 34 of 1938), to each member of Dáil Éireann, with effect from the 1st day of April, 1997, shall be£35,754.

(2) The annual sum by way of salary payable monthly under subsection (2) (inserted by the Act of 1973) of section 3 of the Oireachtas (Allowances to Members) Act, 1938 , to each member of Seanad Éireann, with effect from the 1st day of April, 1997, shall be£22,624.

4. The annual sum by way of salary payable under subsection (1) (inserted by the Act of 1973) or subsection (2) (inserted by the Act of 1977) of section 3 of the Act of 1938 shall be, with effect from the 1st day of April, 1997, a sum not exceeding—

(a) in the case of the Taoiseach —£68,781,

(b) in the case of the Tánaiste —£54,136,

(c) in the case of a member of the Government, other than the Taoiseach or the Tánaiste —£47,672, and

(d) in the case of a Minister of State appointed under section 1 of the Ministers and Secretaries (Amendment) (No. 2) Act, 1977 (No. 28 of 1977) —£21,412.

5. The annual sum by way of salary payable under section 4 (inserted by the Act of 1973) of the Act of 1938 to the Attorney General shall be, with effect from the 1st day of April, 1997, a sum not exceeding—

(a) in case the person who holds the office is not a member of either House of the Oireachtas —£83,426, and

(b) in case a member of either House of the Oireachtas holds the office —£47,672.

6. (1) The annual sum by way of salary payable under subsection (1) (inserted by the Act of 1973) of section 5 of the Act of 1938 shall be, with effect from the 1st day of April, 1997, a sum not exceeding—

(a) in the case of the Chairman of Dáil Éireann —£47,672, and

(b) in the case of the Deputy Chairman of Dáil Éireann —£21,412.

7. The annual sum by way of salary payable under subsection (1) (inserted by the Act of 1973) of section 6 of the Act of 1938 shall be, with effect from the 1st day of April, 1997, a sum not exceeding—

(a) in the case of the Chairman of Seanad Éireann —£19,570, and

(b) in the case of the Deputy Chairman of Seanad Éireann —£10,626.

8. The annual sum by way of allowance for expenses payable under section 10 (inserted by section 5 of the Act of 1996) of the Act of 1938 shall be, with effect from the 1st day of April, 1997, a sum not exceeding—

(a) where payable under subsection (1)(a) of the said section 10 —£26,794,

(b) where payable under subsection (1)(b) of the said section 10 —£21,435,

(c) where payable under subsection (1)(c) of the said section 10 —£10,717,

(d) where payable under subsection (1)(d) of the said section 10, —£5,359, and

(e) where payable under subsection (4) of the said section 10 —£10,717.

EXPLANATORY NOTE.

This Order applies the increases recommended in Report No. 37 of the Review Body on Higher Remuneration in the Public Sector, with some modifications, to the salaries of members in the Houses of the Oireachtas, including Office-holders, with effect from 1 April 1997. The Order also provides for increases in the sums payable to leaders of qualified parties and Independents in Dáil Éireann.
