SOCIAL WELFARE (CONSOLIDATED CONTRIBUTIONS AND INSURABILITY) (AMENDMENT) (NO. 3) (HOMEMAKERS) REGULATIONS, 1997

The Minister for Social Welfare, in exercise of the powers conferred on him by sections 4 and 27 (as amended by section 24 of the Social Welfare Act, 1996 (No. 7 of 1996)) of the Social Welfare (Consolidation) Act, 1993 (No. 27 of 1993), hereby makes the following Regulations:

1 Citation and construction

1. (1) These Regulations may be cited as the Social Welfare (Consolidated Contributions and Insurability) (Amendment) (No. 3) (Homemakers) Regulations, 1997.

(2) These Regulations and the Social Welfare (Consolidated Contributions and Insurability) Regulations, 1996 to 1997 shall be construed together as one and may be cited as the Social Welfare (Consolidated Contributions and Insurability) Regulations, 1996 to 1997.

2 Credited contributions

2. The Social Welfare (Consolidated Contributions and Insurability) Regulations, 1996 ( S.I. No. 312 of 1996 ) are hereby amended by the insertion after article 59 of the following article:

"Homemaker credits.

59A. (1) Subject to these Regulations, employment contributions shall be credited to an insured person in the contribution year in which the insured person becomes or ceases to be a homemaker within the meaning of section 83 (2) (as amended by section 24 of the Social Welfare Act, 1996 (No. 7 of 1996)).

(2) Contributions shall be credited under this article in respect of each contribution week commencing from

( a ) the contribution week in which the insured person becomes a homemaker up to the end of the said contribution year or ceases to be a homemaker, whichever is the earlier, and

( b ) the beginning of the contribution year in which the insured person, who was a homemaker in the previous contribution year, ceases to be a homemaker up to the end of the contribution week in which the said cessation occurs.

(3) Employment contributions credited under this article shall be reckoned only for the purposes of old age (contributory) pension.".

EXPLANATORY NOTE

These Regulations provide that Homemakers shall be awarded credits on commencement as a Homemaker

— to the end of the contribution year or to cessation as a Homemaker, whichever occurs first, or

— where the insured person who was a Homemaker in the previous contribution year ceases to be a Homemaker, from the beginning of the contribution year to the week of cessation.

Credits awarded under these Regulations shall be reckonable for Old Age (Contributory) Pension only.
