OIREACHTAS (TERMINATION ALLOWANCE) (AMENDMENT) REGULATIONS, 1997.

I, RUAIRÍ QUINN, Minister for Finance, in exercise of the powers conferred on me by section 5 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1992 (No. 3 of 1992), hereby make the following Regulations:

1. These Regulations may be cited as the Oireachtas (Termination Allowance) (Amendment) Regulations, 1997.

2. The Oireachtas (Termination Allowance) Regulations, 1992 ( S.I. No. 356 of 1992 ) are hereby amended—

( a ) in Regulation 3 (1), by the insertion of the following definition:

" 'additional allowance' means an allowance payable pursuant to section 2 or 3 of the Oireachtas (Allowances to Members) (Amendment) Act, 1994 (No. 21 of 1994);",

( b ) in Regulation 8, by the substitution for "subject to Regulation 10 (2)" of "subject to Regulations 8A and 10 (2)", and

( c ) the insertion of the following Regulation after Regulation 8:

"8A. Where a person to whom these Regulations apply has been paid an additional allowance in respect of any part of the person's relevant period of continuous service, the relevant amount referred to in Regulation 8 in respect of the person shall be increased by the addition thereto of the aggregate of the amount obtained by the formula—

in respect of each occasion on which an additional allowance was paid to the person, where—

R is the annual rate of the allowance for the time being appropriate to the position in respect of which the allowance was paid,

S is the number of days in respect of which the said allowance was paid to the person,

and

T is the total number of days in the relevant period of continuous service.".

EXPLANATORY NOTE.

The Oireachtas (Allowances to Members) (Amendment) Act, 1994 , provided for the payment of additional allowances to certain members of the Oireachtas who, for example, act as chairpersons of Oireachtas Committees. These Regulations provide that termination allowances payable to former members of the Oireachtas under the Oireachtas (Termination Allowances Regulations, 1992, shall take into account periods of service which attracted payment of these additional allowances.
