EUROPEAN COMMUNITIES (VEHICLE TESTING) (AMENDMENT) (NO. 2) REGULATIONS, 1996.

The Minister for the Environment in exercise of the powers conferred on him by section 3 of the European Communities Act, 1972 (No. 27 of 1972) and for the purpose of giving effect to Council Directive 77/143/EEC(1) as amended by Council Directive 88/449/EEC(2) hereby makes the following Regulations:

1. (1) These Regulations may be cited as the European Communities (Vehicle Testing) (Amendment) (No. 2) Regulations, 1996.

(2) The European Communities (Vehicle Testing) Regulations 1991 to 1996 and these Regulations shall be construed as one and that citation shall include these Regulations.

2. These Regulations shall be deemed to have come into operation on the 1st day of January, 1996.

3. The European Communities (Vehicle Testing) Regulations, 1991 ( S.I. No. 356 of 1991 ) are hereby amended by—

(a) the insertion, after "shall" in article 17, of ", subject to article 18," and

(b) the substitution for article 18 of the following article:

"18. (1) In respect of the fees payable under the provisions of these Regulations and received by any issuing authority, that authority may, before payment into the Exchequer of such fees, deduct from such fees, an amount calculated in accordance with directions in writing issued by the Minister for the Environment, with the consent of the Minister for Finance, in respect of expenses properly incurred by the issuing authority in respect of the collection of such fees.

(2) The expenses referred to in sub-article (1) may include expenses properly incurred by the issuing authority in respect of the collection of the said fees during any period prior to the 1st day of January, 1996 and which have not been met by recoupment out of moneys provided by the Oireachtas.".

EXPLANATORY NOTE.

These Regulations enable licensing authorities to meet their expenses under the Vehicle Testing Regulations by way of deduction of a specified amount from vehicle testing fees before payment to the Exchequer of such fees. The Regulations come into effect on 1st January, 1996.
