	Action for damages under 1974 Convention deemed to be action founded on tort.	28.—(1) An action for damages under the 1974 Convention (“a 1974 Convention action”) shall be deemed for the purposes of every enactment and rule of law to be an action founded on tort.
		(2) Subsection (1) shall not have the effect of applying to a 1974 Convention action a provision of an enactment or a rule of law that is inconsistent with a provision of the 1974 Convention.
