EUROPEAN COMMUNITIES (INTRODUCTION OF ORGANISMS HARMFUL TO PLANTS OR PLANT PRODUCTS) (PROHIBITION) (AMENDMENT) (NO. 3) REGULATIONS, 1995.

I, IVAN YATES, Minister for Agriculture, Food and Forestry, in exercise of the powers conferred on me by Section 3 of the European Communities Act, 1972 (No. 27 of 1972) and for the purposes of giving effect to Commission Directive 95/40/EC of 19 July 1995(1) and Commission Directive 95/41/EC of 19 July 1995(1) hereby make the following Regulations:

1. (1) These Regulations may be cited as the European Communities (Introduction of Organisms Harmful to Plants or Plant Products) (Prohibition) (Amendment) (No. 3) Regulations, 1995.

(2) The collective citation "the European Communities (Introduction of Organisms Harmful to Plants or Plant Products) (Prohibition) Regulations 1980 to 1995" shall include these Regulations.

2. In these Regulations "the Principal Regulations" means the European Communities (Introduction of Organisms Harmful to Plants or Plant Products) (Prohibition) Regulations, 1980 ( S.I. No. 125 of 1980 ).

3. Regulation 2 of the Principal Regulations is hereby amended by the substitution in paragraph (1) in the definition of "the Directive" for "and Commission Directive 95/4/EC of 21 February 1995." (inserted by the European Communities (Introduction of Organisms Harmful to Plants or Plant Products) (Prohibition) (Amendment) (No. 2) Regulations, 1995 ( S.I. No. 92 of 1995 )) of ", Commission Directive 95/4/EC of 21 February 1995, Commission Directive 95/40/EC of 19 July 1995 and Commission Directive 95/41/EC of 19 July 1995.".

EXPLANATORY NOTE.

These Regulations implement (i) the provisions of Commission Directive 95/40/EC which amends the provisions of Directive 92/76/EEC in relation to certain protected zones of the Union and extends the period of provisional recognition of these zones until 1 April 1996 and in the case of Austria, Finland and Sweden until 31 December 1996 and (ii) the provisions of Commission Directive 95/41/EC which amends certain annexes to Council Directive 77/93/EEC on protective measures against the introduction into the EU of organisms harmful to plants or plant products and against their spread within the Union.
