AIR NAVIGATION (PERSONNEL LICENSING) (AMENDMENT) ORDER, 1995.

The Irish Aviation Authority , in exercising the powers conferred on it by Sections 5 , 58 (1), 60 (1) and 75 of The Irish Aviation Authority Act, 1993 (No. 29 of 1993), and having informed the Minister for Transport, Energy and Communications of its intention to make the order and its purpose under Section 5, (8), of the Act, hereby orders as follows:—

1. This order may be cited as the Air Navigation (Personnel Licensing) (Amendment) Order, 1995.

2. This order shall come into operation on the 25th day of August, 1995.

3. In this order

"Irish Airspace" means the Airspace within the lateral limits of the Shannon Flight Information Region, and the Shannon Upper Flight Information Region, established pursuant to the Chicago Convention;

"multi-pilot crew" means two or more pilots assigned to a single aircraft;

4. The Air Navigation (Personnel Licensing) Order 1966 ( S.I. No. 165 of 1966 ) is hereby amended by the deletion of Articles 41, paragraphs (4), (5) and (6) and the substitution of the following paragraphs in their place.

(4) Commercial Pilot's Licence (Aeroplanes or Helicopters).

The holder of this licence may exercise all the privileges of a private pilot's licence (aeroplanes or helicopters) as set out in paragraph (3) of this Article and may—

( a ) act as pilot in command of any aircraft, when operated as a private or an aerial work aircraft, of the type or types specified in Part I of the aircraft rating on his licence;

( b ) act as pilot in command of any aircraft, when operated as a public transport aircraft, of the type or types specified in part I of the aircraft rating on his licence which does not exceed a maximum total authorised weight of 12,500 1b.;

( c ) act as co-pilot of—

(i) any aircraft, when operated as a private, public transport or an aerial work aircraft, of the type or types specified in part I or part II of the aircraft rating on his licence;

(ii) any aircraft, when operated as a public transport aircraft (not carrying passengers) or an aerial work aircraft, of the category and class specified in the aircraft rating on his licence which does not exceed a maximum total authorised weight of 12,500 lb. and which is not a helicopter or an aircraft of an unconventional type;

Provided that the holder of the licence—

( a ) subject to any endorsement on his licence under the provisions of paragraph (3) of Article 35 of this Order, may not act as pilot in command while carrying passengers at night unless a current instrument rating appropriate to the category of aircraft flown is included in the licence or unless, within the period of three months immediately preceeding the flight on which passengers are to be carried, he has carried out at night at least five take-offs and five landings while acting as pilot in command of an aircraft of the category flown;

( b ) subject to (c) below shall not at any time after he attains the age of sixty years fly as pilot in command of a public transport aircraft operating outside Irish Airspace, except as a member of a multi-pilot crew and provided that such holder is the only pilot in the flight crew who has attained the age of 60 years;

( c ) shall not at any time after he attains the age of sixty-five years act as a pilot of a public transport aircraft;

(5) Senior Commercial Pilot's Licence (Aeroplanes).

The holder of this licence may exercise all the privileges of a pilot's licence endorsed with the aeroplane category rating as set out in paragraph (3) of this Article and may—

( a ) act as pilot in command of any aeroplane, when operated as a private or an aerial work aircraft, of the type or types specified in part I of the aircraft rating on his licence;

( b ) act as pilot in command of any aeroplane, when operated as a public transport aircraft, of the type or types specified in part I of the aircraft rating on his licence which does not exceed a maximum total authorised weight of—

(i) if the aircraft is carrying passengers — 45,000 lb.;

(ii) if the aircraft is not carrying passengers — 50,000 lb.;

( c ) act as co-pilot of—

(i) any aeroplane, when operated as a private, public transport or an aerial work aircraft, of the type or types specified in part I or part II of the aircraft rating on his licence;

(ii) any aeroplane, when operated as a public transport aircraft (not carrying passengers) or an aerial work aircraft, of the category and class specified in the aircraft rating on his licence which does not exceed a maximum total authorised weight of 12,500 lb. and which is not an aircraft of an unconventional type;

Provided that the holder of the licence—

( a ) may only exercise privileges appropriate in accordance with paragraph (4) of this Article to a commercial pilot's licence endorsed with the aeroplane category rating, if his instrument rating aeroplanes is not current;

( b ) subject to (c) below shall not at any time after he attains the age of sixty years fly as pilot in command of a public transport aircraft operating outside Irish Airspace, except as a member of a multi-pilot crew and provided that such holder is the only pilot in the flight crew who has attained the age of sixty years;

( c ) shall not at any time after he attains the age of sixty-five years act as pilot of a public transport aircraft.

(6) Airline Transport Pilot's Licence (Aeroplanes or Helicopters).

The holder of this licence may exercise all the privileges of a private pilot's licence (aeroplanes or helicopters) as set out in paragraph (3) of this Article and may—

( a ) act as pilot in command of any aircraft, when operated as a private or an aerial work aircraft, of the type or types specified in part I on the aircraft rating on his licence;

( b ) act as pilot in command of an aircraft, when operated as a public transport aircraft, of the type or types specified in part I of the aircraft rating on his licence;

( c ) act as co-pilot of—

(i) any aircraft when operated as a private, public transport or an aerial work aircraft of the type or types specified in part I or part II of the aircraft rating on his licence;

(ii) any aircraft when operated as a public transport aircraft (not carrying passengers) or an aerial work aircraft of the category and class specified in the aircraft rating on his licence which does not exceed a maximum total authorised weight of 12,500 lb. and which is not a helicopter or an aircraft of an unconventional type;

Provided that the holder of the licence—

( a ) may only exercise privileges in accordance with paragraph (4) of this Article if the aircraft flown is an aeroplane and if his instrument rating — aeroplanes is not current;

( b ) subject to (c) below shall not at any time after he attains the age of sixty years fly as pilot in command of a public transport aircraft operating outside Irish Airspace, except as a member of a multi-pilot crew and provided that such holder is the only pilot in the flight crew who has attained the age of sixty years;

( c ) shall not at any time after he attains the age of sixty-five years act as a pilot of a public transport aircraft.

EXPLANATORY NOTE.

This Order amends the Air Navigation (Personnel Licensing) Order, 1966 by removing aircraft weight limitations from the pilot in command privileges of Airline Transport Pilot licences for licence holders over the age of 60 years and by restricting the exercise of all professional pilot privileges to pilots under the age of 65 years. Where a public transport aircraft is operated outside Irish Airspace the holder of a professional pilot licence over the age of 60 years may act as a member of a multi-pilot crew provided that such holder is the only pilot in the flight crew who has attained the age of 60 years. Where a public transport aircraft is operated solely within Irish Airspace, the holder of a professional pilot licence up to the age of sixty-five years may act as pilot in command.
