HOUSING (TRANSFER OF FUNCTIONS) (NO. 2) ORDER, 1995.

In exercise of the powers conferred on the Minister for the Environment by section 23 (3) of the Housing (Miscellaneous Provisions) Act, 1992 (No. 18 of 1992), which powers are delegated to me by the Environment (Delegation of Ministerial Functions) Order, 1995 ( S.I. No. 3 of 1995 ), I, LIZ McMANUS, Minister of State at the Department of the Environment, hereby order as follows:—

1. This order may be cited as the Housing (Transfer of Functions) (No. 2) Order, 1995.

2. This order shall come into operation on 1st day of August, 1995.

3. The functions of the council of the county of Westmeath as respects sections 2 to 4 and sections 6 and 7 of the Housing (Miscellaneous Provisions) Act, 1992 , are, in the case of the urban district of Athlone hereby transferred to the council of the said urban district.

4. The council of the urban district of Athlone shall, as respects the said urban district, perform the functions hereby transferred separately from the functional area of the council of the county of Westmeath.

5. (1) Expenses in relation to the performance of the functions hereby transferred shall be defrayed out of the municipal fund of the urban district of Athlone.

(2) In this article "municipal fund" has the meaning assigned to it by the Local Government Act, 1946 (No. 24 of 1946).

EXPLANATORY NOTE.

This order transfers to Athlone Urban District Council, as respects their functional area, certain functions performed by Westmeath County Council in relation to shared ownership leases and the granting of assistance to approved housing bodies.
