EUROPEAN COMMUNITIES (SAMPLING AND ANALYSIS OF FERTILISERS) REGULATIONS, 1995.

I, IVAN YATES, Minister for Agriculture, Food and Forestry, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972) and for the purpose of giving effect to Commission Directive 95/8/EC of 10 April, 1995⁽¹⁾, hereby make the following Regulations:

1. (1) These Regulations may be cited as the European Communities (Sampling and Analysis of Fertilisers) Regulations, 1995, and shall come into operation on the on the 1st day of July, 1995.

(2) The European Communities (Sampling and Analysis of Fertilisers) Regulations, 1978 to 1993, and these Regulations may be cited together as the European Communities (Sampling and Analysis of Fertilisers) Regulations, 1978 to 1995.

2. Regulation 2 of the European Communities (Sampling and Analysis of Fertilisers) Regulations, 1978 ( S.I. No. 12 of 1978 ), is hereby amended by the substitution for the definition of "the directive" (Inserted by the European Communities (Sampling and Analysis of Fertilisers) Regulations, 1993 ( S.I. No. 257 of 1993 )), of the following definition:

" 'the Directive' means commission Directive No. 77/535/EEC of 22 June, 1977⁽²⁾, as amended by—

( a ) Commission Directive No. 79/138/EEC of 14 December, 1978⁽³⁾,

( b ) Commission Directive No. 87/566/EEC of 24 November, 1987⁽⁴⁾,

( c ) Commission Directive 89/519/EEC of 1 August, 1989⁽⁵⁾,

( d ) Commission Directive 93/1/EEC of 21 January, 1993⁽⁶⁾ and

( e ) Commission Directive 95/8/EC of 10 April, 1995."

3. References in the European Communities (Marketing of Fertilisers) Regulations, 1978 ( S.I. No. 13 of 1978 ), to the European Communities (Sampling and Analysis of Fertilisers) Regulations, 1978, shall be construed as references to the European Communities (Sampling and Analysis of Fertilisers) Regulations, 1978 to 1995.

EXPLANATORY NOTE.

These Regulations lay down official methods of analysis for fertilisers containing the trace elements, boron, cobalt, copper, iron, manganese, molybdenum and zinc at a concentration greater than 10 per cent.
