SHEEP SCAB (IRELAND) ORDER OF 1905 (AMENDMENT) ORDER, 1994.

I, BRIAN O'SHEA, Minister of State at the Department of Agriculture, Food and Forestry, in exercise of the powers conferred on me by sections 3 and 35 of the Diseases of Animals Act, 1966 (No. 6 of 1966), as adapted by the Agriculture and Food (Alteration of Name of Department and Title of Minister) Order, 1993 ( S.I. No. 11 of 1993 ), and the Agriculture, Food and Forestry (Delegation of Ministerial Functions) Order, 1993 ( S.I. No. 45 of 1993 ), hereby order as follows:—

1. (1) This Order may be cited as the Sheep Scab (Ireland) Order of 1905 (Amendment) Order, 1994.

(2) The Sheep (Ireland) Order of 1905 and this Order may be cited together as the Sheep Scab Orders, 1905 and 1994.

(3) In this Order "the Principal Order" means the Sheep Scab (Ireland) Order of 1905.

2. The Principal Order is hereby amended by—

( a ) the substitution of the following Article for Article 1:

"1. (1) Any person who has or has had in his possession or under his charge any sheep or sheep carcase which is affected with sheep scab or which he suspects to be so affected, and any veterinary surgeon who, whether by reason of an examination or otherwise, believes or suspects that any sheep or sheep carcase is so affected, shall with all practicable speed, notify the fact to—

( a ) the Secretary, Department of Agriculture, Food and Forestry, Dublin 2, or

( b ) an inspector of the Local Authority, or

( c ) the Local Authority.

(2) Any person who has in his possession or under his charge any sheep or sheep carcase affected with or suspected of being affected with sheep scab shall forthwith take such steps as are necessary to ensure that the sheep or sheep carcase shall be kept on the land or premises concerned and the sheep shall as far as practicable be isolated from other sheep.";

( b ) the deletion in Article 3 of—

(i) the words "or otherwise treated for sheep scab" and

(ii) the words "Provided that sheep which have been so dipped under and in accordance with this Article shall not be again required to be dipped until after the expiration of ten days.".

3. (1) The Principal Order shall be construed and have effect as if any reference in that Order to—

( a ) "dips", "dipping" or "dipped" is a reference to "treats", "treatment" or "treated" respectively;

( b ) "dip", "sheep-dip" or "efficient sheep-dip" is a reference to an authorised sheep scab treatment; and

( c ) "dipped in an efficient sheep-dip" is a reference to treatment for sheep scab with an authorised sheep scab treatment.

(2) In this article—

"authorised sheep scab treatment" means—

( a ) a veterinary medicinal product authorised in accordance with the European Communities (Veterinary Medicinal Products) Regulations, 1986 ( S.I. No. 22 of 1986 ) for the treatment of sheep scab, or

( b ) a sheep dip approved under the Sheep Dipping Order, 1965 (No. 105 of 1965); and

"treatment" means treatment with—

( a ) a veterinary medicinal product in accordance with the terms and conditions of the product authorisation issued in respect of that product under the European Communities (Veterinary Medicinal Products) Regulations, 1986 ( S.I. No. 22 of 1986 ), or

( b ) a sheep dip approved under the Sheep Dipping Order, 1965 (No. 105 of 1965).

EXPLANATORY NOTE.

The effect of this Order is to update the provisions of the Sheep Scab (Ireland) Order of 1905, and particularly to enable the use of both dip and non-dip sheep scab treatments.
