S.I. No. 214/1994 - Social Welfare (Supplementary Welfare Allowance) Regulations, 1994.


The Minister for Social Welfare, in exercise of the powers conferred on him by sections 4 and 243 of the Social Welfare (Consolidation) Act, 1993 (No. 27 of 1993), hereby makes the following Regulations:—

1 Citation.

1. These Regulations may be cited as the Social Welfare (Supplementary Welfare Allowance) Regulations, 1994.

2 Interpretation.

2. In these Regulations "the Principal Act" means the Social Welfare (Consolidation) Act, 1993 .

3 Application of Principal Act.

3. Paragraph (i) of Rule 1 (4) of Part II of the Third Schedule to the Principal Act shall apply, without modification, to the calculation of weekly means for the purposes of ascertaining a person's entitlement to supplementary welfare allowance pursuant to section 117 of the said Act.

4 Calculation of means.

4. In calculating the weekly means of a person for supplementary welfare allowance pursuant to section 177 of the Principal Act, there shall be included in the list of exclusions set out in Rule 1 (1) of Part III of the Third Schedule of the said Act the following paragraph:

"(k) any income arising from a grant or allowance in pursuance of a scheme for promoting the welfare of the blind prepared under section 2 of the Blind Persons Act, 1920.".

EXPLANATORY NOTE.

These Regulations provide that the Blind Welfare Allowance will not be taken into account in calculating means for the purposes of ascertaining a person's entitlement to Supplementary Welfare Allowance.
