SEA POLLUTION ACT, 1991 (SURVEY FEES) ORDER, 1994.

I, DAVID ANDREWS, Minister for the Marine, in exercise of the powers conferred on me by Section 17 of the Sea Pollution Act, 1991 (No. 27 of 1991), and with the consent of the Minister for Finance, hereby order as follows:

1 Citation.

1. This Order may be cited as the Sea Pollution Act, 1991 (Survey Fees) Order, 1994 and shall come into operation on the 1st day of July, 1994.

2 Interpretation.

2. (1) In this Order:—

"chemical tanker" means a ship constructed or adapted primarily to carry a cargo of noxious liquid substances in bulk and an oil tanker when carrying a cargo or part cargo of noxious liquid substances in bulk;

"combination carrier" means a ship designed to carry either oil or solid cargoes in bulk;

"gas carrier" means a cargo ship constructed or adapted and used for the carriage in bulk of any liquefied gas;

"IOPP Certificate" means an International Oil Pollution Prevention Certificate issued under the Sea Pollution (Prevention of Oil Pollution) Regulations, 1994 ( S.I. No. 44 of 1994 );

"IPPC Certificate" means an International Pollution Prevention Certificate for the Carriage of Noxious Liquid Substances in Bulk issued under the Sea Pollution (Control of Pollution by Noxious Liquid Substances in Bulk) Regulations, 1994 ( S.I. No. 46 of 1994 );

"oil tanker" means a ship constructed or adapted primarily to carry oil in bulk in its cargo spaces and includes combination carriers and any chemical tanker or gas carrier when carrying a cargo or part cargo of oil in bulk;

(2) A reference in this Order to an initial survey, renewal survey, annual survey, intermediate survey, additional survey and endorsements has, in its application as appropriate, the same meaning as it has in the Sea Pollution (Prevention of Oil Pollution) Regulations, 1994, or the Sea Pollution (Control of Pollution by Noxious Liquid Substances in Bulk) Regulations, 1994.

3 Initial Surveys

3. (1) The amount of fee payable in respect of the initial survey of a ship, other than an oil tanker or a chemical tanker, for the issue of an IOPP Certificate or an IPPC Certificate, as the case may be, shall be—

( a )

in the case of a ship under 1,600 gross tons

£210;

( b )

in the case of a ship of 1,600 gross tons or over but not over 5,000 gross tons

£350;

( c )

in the case of a ship over 5,000 gross tons

£475.

(2) The amount of fee payable in respect of the initial survey of an oil tanker not over 5,000 gross tons for the issue of an IOPP Certificate or a chemical tanker not over 5,000 gross tons for the issue of an IPPC Certificate, shall be—

( a )

in the case of a ship under 1,600 gross tons

£680;

( b )

in the case of a ship of 1,600 gross tons or over but not over 5,000 gross tons

£1,360.

(3) The amount of fee payable in respect of the initial survey of an oil tanker over 5,000 gross tons but not over 30,000 gross tons for the issue of an IOPP Certificate or a chemical tanker over 5,000 gross tons but not over 30,000 gross tons for the issue of an IPPC Certificate shall be £2,130 together with £275 for each 1,000 gross tons or part thereof by which the tanker exceeds 5,000 gross tons.

(4) The amount of fee payable in respect of the initial survey of an oil tanker over 30,000 gross tons for the issue of an IOPP Certificate or a chemical tanker over 30,000 gross tons for the issue of an IPPC Certificate shall be £9,000 together with £44 per hour or part thereof for all work carried out.

4 Renewal surveys

4. (1) The amount of fee payable in respect of a renewal survey of a ship, other than an oil tanker or a chemical tanker, for the issue of an IOPP Certificate or an IPPC Certificate, as the case may be, shall be—

( a )

in the case of a ship under 1,600 gross tons

£175;

( b )

in the case of a ship of 1,600 gross tons or over but not over 5,000 gross tons

£275;

( c )

in the case of a ship over 5,000 gross tons

£350.

(2) The amount of fee payable in respect of a renewal survey of an oil tanker for the issue of an IOPP Certificate or a chemical tanker for the issue of an IPPC Certificate, shall be—

( a )

in the case of a ship under 1,600 gross tons

£340;

( b )

in the case of a ship of 1,600 gross tons or over but not over 5,000 gross tons

£455;

( c )

in the case of a ship over 5,000 gross tons

£710;

together with £44 per hour or part thereof for all work carried out in excess of 4 hours.

5 Annual survey or intermediate survey

5. (1) The amount of fee payable in respect of an annual survey or an intermediate survey of a ship, other than an oil tanker or a chemical tanker, shall be—

( a )

in the case of a ship under 1,600 gross tons

£150;

( b )

in the case of a ship of 1,600 gross tons or over but not over 5,000 gross tons

£240;

( c )

in the case of a ship over 5,000 gross tons

£300.

(2) The amount of fee payable in respect of an annual survey or an intermediate survey of an oil tanker or a chemical tanker shall be—

( a )

in the case of a ship under 1,600 gross tons

£275;

( b )

in the case of a ship of 1,600 gross tons or over but not over 5,000 gross tons

£360;

( c )

in the case of a ship over 5,000 gross tons

£570;

together with £44 per hour or part thereof for all work carried out in excess of 4 hours.

6 Additional Survey

6. A fee of £44 per hour or part thereof shall be payable for all work carried out by way of additional survey.

7 Endorsements

7. A fee of £44 per hour or part thereof shall be payable for all work carried out in respect of endorsements.

EXPLANATORY NOTE.

The Order prescribes fees payable in respect of surveys and certifications and endorsements of tankers and other ships used for the carriage of oil and noxious liquid substances in bulk.
