National Monuments (Amendment) Act, 1994

Amendment of section 3 of Act of 1987.

18.—Section 3 of the Act of 1987 is hereby amended by—

(a) the substitution of the following subsection for subsection (6):

“(6) (a) A person who finds a wreck (being a wreck which is more than 100 years old) that is lying on, in or under the sea bed or on or in land covered by water, shall, within 4 days after such finding, make a report of the finding to a member of the Garda Síochána or to the Commissioners and shall, when making the report, give to the member or to the Commissioners his name and address, state the nature of the wreck and the time and place at which and the circumstances in which it was found by him and shall also (and whether he has or has not made such report as aforesaid and irrespective of the person to whom he has made the report (if any)) give to any member of the Garda Síochána or the Commissioners on request any information within his knowledge in relation to the wreck.

(b) A person who finds an object (being an archaeological object) that is lying on, in or under the sea bed or on or in land covered by water, shall, within 4 days after such finding make a report of the finding to the Director or a designated person and shall, when making the report, give to the Director or a designated person his name and address, state the nature of the object and the time and place at which and the circumstances in which it was found by him and shall also give to the Director or a designated person on request any information within his knowledge in relation to the object.”,

(b) the insertion of the following subsection:

“(13) In this section ‘water’ has the meaning assigned to it by section 1 of the National Monuments (Amendment) Act, 1994.”.
