LOCAL GOVERNMENT (PLANNING AND DEVELOPMENT) REGULATIONS, 1993.

The Minister for the Environment, in exercise of the powers conferred on him by section 10 of the Local Government (Planning and Development) Act, 1963 (No. 28 of 1963) and by section 4 of that Act as amended by the European Communities (Environmental Impact Assessment) Regulations, 1989 ( S.I. No. 349 of 1989 ), hereby makes the following Regulations:—

1 Citation.

1. (1) These Regulations may be cited as the Local Government (Planning and Development) Regulations, 1993.

(2) The collective citation "the Local Government (Planning and Development) Regulations, 1977 to 1993" shall include these Regulations.

2 Interpretation.

2. In these Regulations "the Acts" means the Local Government (Planning and Development) Acts, 1963 to 1993.

3 Certain development to be exempted development.

3. (1) Subject to sub-article (2) of this article, development that a county council established by section 11 of the Local Government (Dublin) Act, 1993 (No. 31 of 1993) commences within the functional area of another county council established by that section during the period of two years commencing on the 1st day of January, 1994 shall be exempted development for the purposes of the Acts.

(2) Notwithstanding sub-article (1) of this article, development which is of a class for the time being specified under Article 24 of the European Communities (Environmental Impact Assessment) Regulations, 1989, or under any provision amending or replacing the said Article 24, shall not be exempted development for the purposes of the Acts.

EXPLANATORY NOTE.

These Regulations provide that certain development which South Dublin County Council, Fingal County Council or Dún Laoghaire-Rathdown County Council commences in the functional area of another of those councils during the period of two years beginning on the establishment of those councils on 1 January, 1994 shall be exempted development.
