CRIMINAL EVIDENCE ACT, 1992 (SECTIONS 13, 15 (4), 16, 17 and 19) (COMMENCEMENT) ORDER, 1993.

I, MÁIRE GEOGHEGAN-QUINN, Minister for Justice, in exercise of the powers conferred on me by section 1 (3) of the Criminal Evidence Act, 1992 (No. 12 of 1992), hereby order as follows:

1. This Order may be cited as the Criminal Evidence Act, 1992 (Sections 13, 15 (4), 16, 17 and 19) (Commencement) Order, 1993.

2. The 30th day of September, 1993, is hereby fixed as the day on which the following sections of Part III of the Criminal Evidence Act, 1992 (No. 12 of 1992), shall come into operation—

( a ) section 13 for the Dublin Metropolitan District of the District Court,

( b ) subsection (4) of section 15 for the Dublin Metropolitan District of the District Court,

( c ) section 16, except subsection (1) (b), for the Dublin Metropolitan District of the District Court,

( d ) section 17, and

( e ) section 19 in so far as it relates to the reference in it to section 16 (1) (a).

EXPLANATORY NOTE.

These Regulations bring into operation certain provisions of the Criminal Evidence Act 1992 . These allow a witness to give evidence through a live television link at the preliminary examination of cases involving physical or sexual abuse before the Dublin Metropolitan District Court, and also allow the transfer of proceedings to a circuit or district court district which has the necessary technical facilities for enabling evidence to be given through a live television link or by means of a videorecording.
