SOCIAL WELFARE (MISCELLANEOUS SOCIAL INSURANCE PROVISIONS) REGULATIONS, 1993.

The Minister for Social Welfare, in exercise of the powers conferred on him by section 3 of the Social Welfare (Consolidation) Act, 1981 (No. of 1981 ) and section 29 of that Act (as amended by section 28 of the Social Welfare Act, 1992 ) hereby makes the following Regulations:—

1 Citation.

1. These Regulations may be cited as the Social Welfare (Miscellaneous Social Insurance Provisions) Regulations, 1993.

2 Substantial loss of employment.

2. The Social Welfare (Miscellaneous Social Insurance Provisions) (No. 2) Regulations, 1992 ( S.I. No. 448 of 1992 ) are hereby amended by the substitution for article 6 of the following article:

"6. A claimant shall be regarded, for the purposes of subsection (1) (d) of section 29 of the Principal Act, as having sustained a substantial loss of employment in any period of six consecutive days as the Minister may determine, where he has lost one day of insurable employment:

Provided that the claimant's reckonable earnings are reduced as a consequence of the loss of employment.".

EXPLANATORY NOTE.

One of the qualifying conditions for entitlement to Unemployment Benefit is that the claimant must have sustained a substantial loss of employment. These Regulations amend the circumstances in which a claimant will be regarded as satisfying this condition by providing that a person who has lost at least one day of insurable employment in any week will be regarded as having suffered a substantial loss of employment.
