EUROPEAN COMMUNITIES (COSMETIC PRODUCTS) (AMENDMENT) REGULATIONS, 1992.

The Minister for Health in exercise of the powers conferred on him by section 3 of the European Communities Act, 1972 (No. 27 of 1972), hereby makes the following Regulations:—

1. These Regulations may be cited as the European Communities (Cosmetic Products) (Amendment) Regulations, 1992.

2. These Regulations shall be construed as one with the European Communities (Cosmetic Products) Regulations, 1990 and 1991 and may be cited with those Regulations as the European Communities (Cosmetic Products) Regulations, 1990 to 1992.

3. In these Regulations "the Principal Regulations" means the European Communities (Cosmetic Products) Regulations, 1990 ( S.I. No. 265 of 1990 ).

4. Article 4 (1) of the Principal Regulations is hereby amended by the addition thereto in the definition of "the Principal Directive" of the references "92/8/EEC26" and "92/86/EEC27".

5. The provisions of Article 7 (1) of the Principal Regulations shall not apply until the 1st day of July 1993, as respects the requirements of Commission Directive 92/86/EEC insofar as that Directive relates to the substances referred to in Article 1 thereof.

6. The provisions of Article 7 (5) of the Principal Regulations shall not apply—

(i) until the 30th day of June 1993, as respects the requirements of Commission Directive 92/8/EEC insofar as that Directive relates to the substances referred to in Article 1 thereof, and

(ii) until 1st day of July 1994, as respects the requirements of Commission Directive 92/86/EEC insofar as that Directive relates to the substances referred to in Article 1 thereof.

EXPLANATORY NOTE.

The purpose of these Regulations is to update the principal regulations by giving effect to the Fourteenth and Fifteenth Commission Directives on cosmetic products (92/8/EEC and 92/86/EEC).

The effect of the Regulations is to further safeguard public health in regard to the substances which may be contained in cosmetic products having regard to the advancement of scientific knowledge in cosmetology.

The use of certain additional substances is permitted while the use of certain other substances is prohibited or permitted subject to certain restrictions and conditions.
