EUROPEAN COMMUNITIES (SEED OF OIL PLANTS AND FIBRE PLANTS) (AMENDMENT) REGULATIONS, 1992.

I, JOE WALSH, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972) and for the purpose of giving effect to Commission Directive 92/9/EEC of 19th February, 1992 (1), hereby make the following Regulations:

1. (1) These Regulations may be cited as the European Communities (Seed of Oil Plants and Fibre Plants) (Amendment) Regulations, 1992, and shall come into operation on the 19th day of October, 1992.

(2) The European Communities (Seed of Oil Plants and Fibre Plants) Regulations, 1981 to 1991, and these Regulations may be cited together as the European Communities (Seed of Oil Plants and Fibre Plants) Regulations, 1981 to 1992, and shall be construed together as one.

2. In these Regulations—

"the Principal Regulations" means the European Communities (Seed of Oil Plants and Fibre Plants) Regulations, 1981 ( S.I. No. 38 of 1981 );

"the Regulations of 1983" means the European Communities (Seed of Oil Plants and Fibre Plants) (Amendment) Regulations, 1983 ( S.I. No. 136 of 1983 );

"the Regulations of 1988" means the European Communities (Seed of Oil Plants and Fibre Plants) (Amendment) Regulations, 1988 ( S.I. No. 64 of 1988 );

"the Regulations of 1991" means the European Communities (Seed of Oil Plants and Fibre Plants) (Amendment) Regulations, 1991 ( S.I. No. 109 of 1991 ).

3. Regulation 2 of the Principal Regulations is hereby amended by the substitution in paragraph (2) (as amended by the Regulations of 1983, the Regulations of 1988 and the Regulations of 1991, and which specifies the Directives, Act and Decision that have amended Council Directive 69/208/EEC of 30 June, 1969(2)) for "and Council Directive 88/380/EEC of 13th June, 1988" of "Council Directive 88/380/EEC of 13th June, 1988(3), and Commission Directive 92/9/EEC of 19th February, 1991".

4. The schedule to the Principal Regulations is hereby amended in Annex 1 by the substitution of the following paragraph for paragraph 4:

"4. Harmful organisms which reduce the usefulness of the seed shall be at the lowest possible level. In the case of Glycine max, this condition is applicable in particular to the organisms Pseudomonas syringae pv. glycinea, Diaporthe phaseolorum var. caulivora and var. sojae, Phialophora gregata and Phytophthora magasperma f.sp. glycinea.".

5. The schedule to the Principal Regulations is hereby amended in Annex II Section 1 by the insertion of the following sub-paragraph after sub-paragraph B of paragraph 3:

"C. Particular standards or other conditions applicable to Glycine max:

( a ) In respect of Pseudomonas syringae pv. glycinea, the maximum number of sub-samples within a sample of 5000 seed minimum per lot subdivided into sub-samples which have been found contaminated by the said organism shall not exceed 4. Where suspect colonies are identified in all five subsamples, appropriate biochemical tests on the suspect colonies isolated on a preferential medium for each subsample may be used to confirm the above standards or conditions.

( b ) In respect of Diaporthe phaseolorum the maximum number of seeds contaminated shall not exceed 15%.

( c ) The percentage by weight of inert matter, as defined in accordance with current international testing methods, shall not exceed 0.3%.".

EXPLANATORY NOTE.

These Regulations amend Annex I and II of the European Communities (Seed of Oil Plants and Fibre Plants) Regulations, 1981, by extending the provisions of the Regulations to a range of harmful organisms which attack soya seed.
