SOCIAL WELFARE ACT, 1992 (SECTIONS 25 AND 26) (COMMENCEMENT) ORDER, 1992.

The Minister for Social Welfare, in exercise of the powers conferred on him by sections 25 (3) and 26 (2) of the Social Welfare Act, 1992 (No. 5 of 1992), hereby orders as follows:—

1 Short title

1. This Order may be cited as the Social Welfare Act, 1992 (Sections 25 and 26) (Commencement) Order, 1992.

2 Commencement.

2. Sections 25 and 26 of the Social Welfare Act, 1992 shall come into operation on the 31st day of August, 1992.

EXPLANATORY NOTE.

This Order brings Sections 25 and 26 of the Social Welfare Act, 1992 into effect from 31st August, 1992.

Section 25 provides for an earnings limit for entitlement to Deserted Wife's Benefit and empowers the Minister to prescribe the circumstances in which a woman is to be regarded as having been deserted by her husband for the purposes of the scheme.

Section 26 provides that, where the income of the claimant exceeds the prescribed earnings limit, Deserted Wife's Benefit will be payable at a reduced personal rate related to the level of income. This section also amends the definition of the period over which the yearly contributions average is calculated for the purposes of entitlement to Deserted Wife's Benefit.
