DISEASE OF ANIMALS ACT, 1966 (FIRST SCHEDULE) (AMENDMENT) ORDER, 1992.

I, JOE WALSH, Minister for Agriculture and Food, in exercise of the powers conferred on me by sections 3 and 11 of the Diseases of Animals Act, 1966 (No. 6 of 1966), as adapted by the Agriculture (Alteration of Name of Department and Title of Minister) Order, 1987 ( S.I. No. 97 of 1987 ), hereby order as follows:

1. (1) This Order may be cited as the Diseases of Animals Act, 1966 (First Schedule) (Amendment) Order, 1992.

(2) The Diseases of Animals Act, 1966 (First Schedule) (Amendment) Orders, 1968 to 1989, and this Order may be cited together as the Diseases of Animals Act, 1966 (First Schedule) (Amendment) Orders, 1968 to 1992.

2. In this Order—

"the Act" means the Diseases of Animals Act, 1966 (No. 6 of 1966);

"the First Schedule" means the First Schedule to the Act, as amended by the Diseases of Animals Act, 1966 (First Schedule) (Amendment) Orders, 1968 to 1989.

3. For all the purposes of the Act, the First Schedule is hereby amended by—

( a ) the substitution in entry No. 20 (inserted by the Diseases of Animals Act, 1966 (First Schedule) (Amendment) Order, 1975 ( S.I. No. 190 of 1975 )) of Part III, Class A thereof of "Equine Encephalomyelitis" for "Venezuelan Equine Encephalomyelitis";

( b ) the insertion in Part III thereof at the end of Class A of the following:

"27 Caseous lymphadenitis.

28 Contagious agalactia.

29 Contagious equine metritis.

30 Equine viral arteritis.

31 Goat pox.

32 Lumpy skin disease.

33 Mycoplasmosis (caused by or involving Mycoplasma gallisepticum or Mycoplasma meleagridis).

34 Peste des petits ruminants.

35 Porcine epidemic diarrhoea (Porcine corona virus).

36 Porcine reproductive and respiratory syndrome.

37 Psittacosis.

38 Rift valley fever.

39 Fowl typhoid (Salmonella gallinarum).

40 Pullorum disease, otherwise known as Bacillary white diarrhoea (Salmonella pullorum).

41 Turkey rhinotracheitis.";

( c ) the substitution in entry No. 2 of Part III, Class B thereof of "Tuberculosis in ruminating animals" for "Bovine Tuberculosis";

( d ) the substitution in entry No. 3 (as amended by the Diseases of Animals Act, 1966 (First Schedule) (Amendment) Order, 1986 ( S.I. No. 285 of 1986 )) of Part III, Class B thereof of "Brucellosis in ruminating animals and swine" for "Brucellosis in cattle, swine, sheep and goats";

( e ) the insertion in Part III thereof at the end of Class B of the following:

"6 Campylobacteriosis (caused by or involving Campylobacter jejuni).

7 Caprine viral arthritis—encephalitis.

8 Enzootic abortion of ewes.

9 Johnes disease.

10 Maedi visna.

11 Mycoplasmosis (caused by or involving Mycoplasma synovia).

12 Pulmonary adenomatosis.

13 Salmonellosis (caused by or involving Salmonella enteriditis or Salmonella typhimurium).

14 Scrapie.

15 Diseases of poultry caused by or involving Yersinia spp.".

4. The Diseases of Animals Act, 1966 (First Schedule) (Amendment) Order, 1975 ( S.I. No. 190 of 1975 ) is hereby amended by the substitution in Article 2 of "For all the purposes of" for "For the purpose of extending the application of sections 12, 13 and 27 of".

5. The Diseases of Animals Act, 1966 (First Schedule) (Amendment) Order, 1977 ( S.I. No. 326 of 1977 ) is hereby amended by the substitution in Article 2 of "For all the purposes of" for "For the purpose of extending the application of sections 12, 13, 14, 15, 17, 18, 27, 42, 45, 47 and 58 of".

6. The Diseases of Animals Act, 1966 (First Schedule) (Amendment) Order, 1986 ( S.I. No. 285 of 1986 ) is hereby amended by the substitution in Article 3 of "For all the purposes of the Act" for "For the purpose of extending the application of sections 12, 13, 14, 15, 17, 18, 28, 42 and 58 of the Act, and all other sections (including sections relating to offences and legal proceedings) containing provisions relative to or consequent on those sections.

EXPLANATORY NOTE.

This order—

( a ) extends the definition of "disease" in the Diseases of Animals Act, 1966 to include further diseases of cattle, goats and other ruminating animals, horses, pigs and poultry and

( b ) extends all the powers in the Act to a group of Class A disease (Nos. 13 to 24 of First Schedule, Part III, Diseases of Animals Act, 1966 .
