EUROPEAN COMMUNITIES (PREVENTION OF SUPPLY OF CERTAIN GOODS AND SERVICES TO LIBYA) REGULATIONS, 1992.

The Minister for Industry and Commerce in exercise of the powers conferred on him by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving full effect to Council Regulation (EEC) No. 945/92(1) of 14 April 1992 hereby makes the following regulations.

1. These Regulations may be cited as the European Communities (Prevention of Supply of Certain Goods and Services to Libya) Regulations, 1992.

2. (1) A person shall not after the date of the making of these Regulations, contravene the relevant provisions.

(2) In this Regulation "the relevant provisions" means the provisions of Council Regulation (EEC) No. 945/92 (1) of 14 April 1992 excluding Article 1 and the third indent to Article 2 thereof.

3. Without prejudice to any other statutory provision, a person who contravenes Regulation 2 of these Regulations shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £1,000, or imprisonment for a term not exceeding 6 months, or both.

4. Where a person, after conviction of an offence under Regulation 2 of these Regulations, continues to contravene that Regulation, he shall be guilty of an offence on every day on which the contravention continues and for each such offence he shall be liable on summary conviction to a fine not exceeding £200.

5. Where an offence under Regulation 2 of these Regulations is committed by a body corporate and is proved to have been so committed with the consent, connivance or approval of or to have been attributable to any neglect of the part of any person, being a director, manager, secretary or other officer of the body corporate or a person who was purporting to act in any such capacity, that person as well as the body corporate, shall be guilty of an offence and shall be liable to be proceeded against and punished as if he were guilty of the first-mentioned offence.

EXPLANATORY NOTE.

The effect of these Regulations is to prohibit the supply of certain goods and services to Libya as provided for in EC Regulation 945/92, and to provide for penalties for infringement of the prohibitions.
