EUROPEAN COMMUNITIES (ANTIOXIDANT IN FOOD) (PURITY CRITERIA) (AMENDMENT) REGULATIONS, 1992.

The Minister for Health, in exercise of the powers conferred on him by section 3 of the European Communities Act, 1972 (No. 27 of 1972), for the purpose of giving full effect to the Council Directive No. 89/397/EEC of the 14th June, 1989 on the Official Control of Foodstuffs(1) hereby makes the following Regulations:

1. These Regulations may be cited as the European Communities (Antioxidant in Food) (Purity Criteria) (Amendment) Regulations, 1992.

2. These Regulations shall come into operation on the 22nd day of April 1992.

3. Article 8 of the European Communities (Antioxidant in Food) (Purity Criteria) Regulations, 1985 ( S.I. No. 187 of 1985 ) is hereby deleted and the following article substituted therefor:—

"8. In any proceedings for an offence under these Regulations, it shall be a defence for the person charged to show that the antioxidant in respect of which the offence is alleged to have been committed was intended for export and complied with the importing country's domestic food legislation relevant to the alleged offence.".

EXPLANATORY NOTE.

These Regulations are a further implementation of EC Directive 89/397/EEC on the Official Control of Foodstuffs.

The exemption previously provided for in the case of export or re-export is replaced with a new provision.
