INLAND POST AMENDMENT (NO. 46) SCHEME 1990.

An Post, in exercise of the powers conferred on it by Section 70 of the Postal and Telecommunications Service Act, 1983 (No. 24 of 1983), hereby makes the following Scheme:—

1. (1) This Scheme may be cited as the Inland Post Amendment (No. 46) Scheme, 1990.

(2) This Scheme shall come into force on the 31st day of October, 1990.

2. In this Scheme:—

'the Principal Warrant' means the Inland Post Warrant, 1939 ( S.I. No. 202 of 1939 ).

3. This Scheme applies to the collection, posting and delivery of parcels from and to all places within the State subject to the conditions stated herein, described herein as the Twenty-Four- Hour Parcel Service.

4. The following conditions shall apply to the Twenty-Four-Hour Parcel Service:

( a ) Delivery of a parcel to any address within the State shall be effected before 1700 hours on the day following the day of posting (excluding Saturdays, Sundays and Public Holidays).

( b ) Where through the fault of An Post delivery of a parcel is not effected before 1700 hours on the day following the day of posting the sender shall be entitled to a refund of the postage paid for the delivery of said parcel.

( c ) Insurance against loss or damage to the value of each parcel, subject to a maximum of £1,000 per parcel, shall be available to the sender.

( d ) The signature of the recipient of the parcel shall be obtained.

( e ) Confirmationof delivery of the parcel shall be available at the request of the sender from the fourth working day after posting up to one year after posting.

5. Regulations 44 and 45 of the Principal Warrant shall not apply to parcels sent in the Twenty-Four-Hour Service.

6. (1) The Principal Warrant shall be amended by the addition of the following after paragraph 5 of Regulation 5:

"(6) There shall be charged and paid for the conveyance of a parcel sent by the Twenty-Four-Hour Parcel Service no rate that exceeds the rate specified in the first column of the Eighth Schedule to this Warrant. The Twenty-Four-Hour Parcel Service shall be subject to the weight limits referred to in the second column of the same Schedule and to the further provisions contained in the body of this Warrant".

(2) The Principal Warrant shall be amended by the addition of the following after the Seventh Schedule:

£6 per parcel sent plus a per Kg rate of 25p. Where a collection facility for parcels sent by the Twenty-Four-Hour Parcel Service is provided by An Post the actual cost incurred in providing such a collection may also be charged.

EXPLANATORY NOTE.

This Scheme, which comes into operation on the 31st day of October, 1990, authorizes An Post to carry on a Twenty-Four-Hour Parcel Service within the State.
