SOCIAL WELFARE (SUPPLEMENTARY WELFARE ALLOWANCES) (AMENDMENT) REGULATIONS, 1990.

The Minister for Social Welfare, in exercise of the powers conferred on him by sections 3 , 209 and 219 of the Social Welfare (Consolidation) Act, 1981 (No.1 of 1981 ), hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the Social Welfare (Supplementary Welfare Allowances) (Amendment) Regulations, 1990.

(2) These Regulations and the Social Welfare (Supplementary Welfare Allowances) Regulations, 1977 to 1989, shall be construed as one and may be cited together as the Social Welfare (Supplementary Welfare Allowances) Regulations, 1977 to 1990.

2. These Regulations shall come into operation on the 23rd day of July, 1990.

3. In these Regulations "the Act" means the Social Welfare (Consolidation) Act, 1981 .

4. Article 6 of the Social Welfare (Supplementary Welfare Allowances) Regulations, 1977 ( S.I. No. 168 of 1977 ) is hereby amended by—

( a ) the substitution in sub-articles (1) (a) and (2) (as amended by article 4 (a) of the Social Welfare (Supplementary Welfare Allowances) (Amendment) Regulations, 1989 ( S.I. No. 200 of 1989 )) of "£3.50" for "£3.20", and

( b ) the insertion after sub-article (6) of the following sub-article:—

"(7) The following provisions shall apply in substitution for sub-articles (1) (a) and (2) of this article in respect of allowances or increases in allowances determined prior to the 2nd day of November, 1987 or in respect of reviews of such cases under article 13 of these Regulations:—

( a ) The weekly amount of an allowance payable to a person to whom section 209 (1) (a) of the Act applies may be increased under the said section where the rent payable by such person, or by a person whose needs are aggregated with his under section 207 (2) (a) of the Act in respect of his or their place of residence exceeds £2.00 a week.

( b ) Subject to the provisions of sub-article (6) of this article, the amount of an increase of a weekly payment to be provided to a person under sub-article (1) of this article shall be as determined by the health board except that, in respect of rent, the amount of the increase shall be the amount by which the rent payable by the person, or a person whose needs are aggregated with his under section 207 (2) (a) of the Act, exceeds £2 a week, or such part of that amount as the health board considers reasonable in the circumstances.".

EXPLANATORY NOTE.

These Regulations provide for an increase from £3.20 to £3.50 in the minimum rent which must be paid by claimants for rent supplements under the supplementary welfare allowances scheme and an increase from £1.70 to £2 in the minimum rent applying in the case of certain claimants.
