FISHERIES (ENVIRONMENTAL IMPACT ASSESSMENT) (No. 2) (REGULATIONS, 1990.

I, JOHN P. WILSON, Minister for the Marine, in exercise of the powers conferred on me by section 15A (as inserted by the European Communities (Environmental Impact Assessment) Regulations, 1989 ( S.I. No. 349 of 1989 )) of the Fisheries Act, 1980 (No. 1 of 1980 ) and the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order, 1977 ( S.I. No. 30 of 1977 ) (as adapted by the Tourism, Fisheries and Forestry (Alteration of Name of Department and Title of Minister) Order, 1987 ( S.I. No. 82 of 1987 ) ), hereby make the following Regulations:

1 Citation.

1. These Regulations may be cited as the Fisheries (Environmental Impact Assessment) (No. 2) Regulations, 1990.

2. In these Regulations "the Act of 1980" means the Fisheries Act, 1980 (No. 1 of 1980).

3. The prescribed period provided in section 54A (2) (d) of the Act of 1980 shall be:

( a ) in the case of prescribed bodies, one month for consideration and response from the date of issue by the applicant of a copy of the environmental impact statement to that body, and

( b ) in the case of any interested person, one month from the date of publication in the newspapers by the applicant giving details of the application and the place where a copy of the environmental impact statement may be inspected or purchased.

4. The prescribed bodies provided in Section 54A (4) of the Act of 1980 shall be:

( a ) an Bord Iascaigh Mhara;

( b ) Údarás na Gaeltachta, where the proposed aquaculture is to take place in, or contiguous to, its functional area;

( c ) Bord Fáilte Éireann;

( d ) the Central Fisheries Board;

( e ) the Regional Fisheries Board within whose functional area, or contiguous to whose functional area, the proposed aquaculture is to take place;

( f ) an Taisce — The National Trust for Ireland;

( g ) the Commissioners for Public Works in Ireland (as regards a proposed development which might have a significant effect on wildlife);

( h ) the Local Authority within whose functional area, or contiguous to whose functional area, the proposed culture is to take place.

EXPLANATORY NOTE.

These Regulations provide, insofar as applications under section 54 of the Fisheries Act, 1980 to engage in the culture of salmonid fish are concerned, for the prescribing of the period for public consideration of and the making of submissions on Environmental Impact Statements provided for under the European Communities (Environmental Impact Assessment) Regulations, 1989 and lists the prescribed bodies to whom the Environmental Impact Statements will be provided for comment.
